Trouble for Zuckerberg: 29 US states seek $1.4T from Meta, putting Facebook, Instagram and his AI ambitions at risk

Washington: Meta CEO Mark Zuckerberg, who has previously faced criticism in India over Facebook’s policies and content moderation, is now confronting a massive legal challenge in the United States, where 29 states are seeking remedies that could potentially expose the company to as much as $1.4 trillion.

The lawsuit, being heard in Oakland, California, accuses Meta of designing Facebook and Instagram features such as infinite scrolling, autoplay and algorithm-driven recommendations to keep young users engaged for longer periods. The states argue that the platforms were designed in ways that encouraged prolonged and compulsive use among children and teenagers.

The $1.4 trillion figure, however, is not a penalty already imposed on Meta. It represents the maximum potential financial exposure calculated from the alleged violations and applicable penalties outlined in court filings. Meta has dismissed the figure as “outlandish”, while California lawyer Megan O’Neill has suggested that a figure closer to $193 billion could be more realistic.

Judge Yvonne Gonzalez Rogers has also questioned the $1.4 trillion calculation, describing it as “unreasonable”. Any financial penalty will ultimately depend on the court’s findings and the judge’s decision.

When Meta Empire Faces Its India Reality Check

Meta’s relationship with India has come under growing scrutiny. The company’s platforms, Facebook and Instagram, have faced criticism over content moderation, harmful content and operational lapses. In July 2026, Facebook briefly restricted a post by Prime Minister Narendra Modi, prompting the Indian government to summon Meta executives; Meta later apologised, calling it an operational error.

Meta’s relationship with India has come under growing scrutiny over content moderation and platform accountability. In August 2026, Mark Zuckerberg also apologised to Indian officials over the presence of child sexual abuse material, deepfake content and other operational lapses on its platforms.

The controversy deepened after government officials said Meta had confirmed that it took money to boost certain types of content on its platforms. This has raised a larger question in India: if content can receive greater visibility through paid promotion, how neutral are Meta’s platforms when they influence what millions of Indians see?

With India tightening its social-media rules and requiring platforms to remove unlawful content within three hours of a government or court notice, Meta is facing a much tougher regulatory environment in one of its largest markets. The government has also warned that Meta could lose safe-harbour protection if it violates Indian laws.

Meta’s AI Strategy Could Face a Bigger Threat

Beyond the potential financial hit, the case could pose a significant challenge to Meta’s growing artificial intelligence ambitions. The states are seeking court orders that could require Meta to change how Facebook and Instagram operate, including restrictions affecting younger users and modifications to recommendation systems and infinite-scrolling features. They are also seeking the deletion of personal data collected from children under 13 without the required parental consent. More significantly, the proposed remedies could potentially extend to AI models and algorithms trained using such data. Such an order could force Meta to identify, review, modify or potentially discard parts of its AI infrastructure if the court determines that children’s data was unlawfully collected and subsequently used to train models or algorithms.

Zuckerberg and Mosseri Could Testify

The five- to six-week trial is expected to feature testimony from Zuckerberg and Instagram chief Adam Mosseri, along with current and former Meta employees and experts in technology and psychology. Zuckerberg has previously faced scrutiny over Instagram’s impact on young users. In testimony in another case, he maintained that Instagram was designed to be useful rather than addictive.

29 States Challenge Meta

California, Colorado, Kentucky and New Jersey are leading claims that Meta violated state consumer protection laws by misleading users about the safety of Facebook and Instagram and by knowingly designing features that encouraged young users to spend more time on the platforms.

A separate claim involving all 29 states alleges that Meta violated the federal Children’s Online Privacy Protection Act, or COPPA, by collecting personal information from children under 13 without obtaining the required parental permission.

Meta has rejected the claims, arguing that the attorneys general have failed to provide sufficient evidence and that the financial demands are disproportionate. The company has also defended its record on teen safety and challenged claims concerning its platform design, age verification and alleged consumer deception.

A Major Test for Big Tech and AI

The outcome could determine whether Meta faces substantial financial consequences and whether Facebook and Instagram must undergo major changes. More importantly, the case could establish a significant precedent for the AI industry. If courts order technology companies to delete or modify AI models trained on data deemed unlawfully collected, the ruling could affect how major technology firms build, train and maintain their artificial intelligence systems.

For Zuckerberg, the case represents a major challenge on home turf. The man behind one of the world’s biggest social-media empires is now facing a courtroom battle that could threaten not only Meta’s finances but also parts of the AI strategy on which the company is betting its future.
