BHOPAL: The Madhya Pradesh Freedom of Religion Act, 2021, one of the country’s strictest laws aimed at curbing religious conversions- is currently in force in Madhya Pradesh. Despite this, cases continue to surface periodically involving allegations of romantic relationships, false promises of marriage, concealment of identity, blackmail and pressure for religious conversion.

Indeed, following the police’s submission of a charge sheet in court regarding a high-profile case in Bhopal involving the rape of a minor student and alleged ‘Love Jihad’, the question has once again arisen; why do such attempts persist despite the existence of stringent laws? The facts revealed in the police charge sheet regarding this latest case have also sparked a fresh debate concerning the effective implementation of the law.

Notably, in a case involving alleged ‘Love Jihad’ and the rape of a minor 11th-grade student, which occurred along the banks of the ‘Bada Talab’ (Upper Lake), specifically in front of the Hotel Imperial Sabre on VIP Road within the Koh-e-Fiza police station limits of the state capital, Bhopal, the police have now submitted a charge sheet against both accused individuals in court. According to the police, a case was registered against the prime accused, Ausaf Khan and his accomplice, Maaz, under various serious sections of the law.

The charge sheet now alleges that the accused raped the victim on six separate occasions along the banks of the ‘Bada Talab’. The police investigation also revealed that three different vehicles were utilized during these incidents. Of these, a Thar SUV and a Ciaz sedan are reported to be linked to the second accused, Maaz, while the third vehicle, a Honda City sedan, was borrowed by the accused from a relative.

Blackmail via Video Recording, Followed by Pressure for Conversion

According to the police charge sheet, the victim stated that on July 5, 2025, Ausaf repeatedly raped her while inside Maaz’s Thar vehicle; during this time, Maaz was recording a video of the incident. Subsequently, this very video allegedly became the tool used for blackmailing the victim. This is because, on every occasion, Ausaf would threaten the victim with making a video of her go viral, take her to the banks of the Upper Lake and sexually assault her. The investigation also revealed that the accused constantly pressured the victim to undergo religious conversion and embrace Islam. Furthermore, the charge sheet submitted by the police claims that the accused would instruct her to wear a ‘burqa’ and alter her religious identity.

Allegations of Intimidation Using Weapons

Another serious allegation has surfaced during the police investigation. According to the charge sheet, the accused kept a gun and a sword inside his car. It is alleged that when the victim rejected his advances and attempted to exit the vehicle, she was intimidated by being shown these weapons. Investigating officers state that the crime was perpetrated by creating an atmosphere of fear and coercion.

According to the police, upon learning that a case had been registered against him, the accused fled to Ajmer. During interrogation, he allegedly admitted that he attempted to evade capture after receiving information that his name had surfaced in connection with the case. The investigation also revealed that while returning to Bhopal, he smashed his mobile phone and discarded it at the Ujjain railway station.

Why Do Such Allegations Persist Despite the Freedom of Religion Act?

In 2021, the Madhya Pradesh government enacted the Freedom of Religion Act with the specific objective of curbing cases of religious conversion. The law stipulates stringent penalties for conversions induced through deceit, inducement, coercion, marriage or by concealing one’s true identity. Despite the existence of this legislation, numerous such cases continue to surface periodically.

This case in Bhopal is not an isolated instance. Over the past few years, numerous cases have continuously emerged from various districts of Madhya Pradesh involving allegations against individuals from the Islamic community regarding forced conversions, establishing relationships by concealing their true identities, and exerting pressure in the name of marriage.

In Bhopal, instances involving allegations of religious conversion and establishing relationships under false identities have been recorded previously, wherein the police initiated action under the Freedom of Religion Act. Similarly, in Indore, complaints were filed by young women in several cases alleging concealment of identity, deception regarding marriage and coercion to undergo religious conversion. In some of these instances, the police constituted Special Investigation Teams to conduct inquiries.

Incidents involving disputes related to religious conversion and the registration of FIRs have also surfaced periodically in districts such as Ujjain, Jabalpur, Khandwa, Ratlam and Sagar. In many of these cases, charge sheets were filed following investigations, while in others, the courts delivered varying verdicts based on the evidence presented.
