Advocate Vishnu Shankar Jain, in a powerful statement before the Supreme Court, emphasised that India’s Hindu heritage and civilisational identity cannot be compromised under legal or political pressures. Speaking on the ongoing disputes over the Gyanvapi and Bhojshala sites, Jain described the matter as one of both faith and irrefutable evidence, including Archaeological Survey of India (ASI) reports, historical facts, and detailed legal arguments.

Jain highlighted the spiritual significance of India’s sacred Shiva shrines, stating, “Out of 12 Jyotirlingas, 5 are Swayambhu, and among these, the very first Jyotirling is Gyanvapi.” He stressed that the sites in question are not just religious symbols, but integral to the identity and continuity of Hindu civilisation.

According to Jain, safeguarding these sites is crucial to preserving India’s historical, spiritual, and cultural fabric.

Jain made it clear that the matter transcends faith, emphasising the availability of documented historical evidence and ASI reports supporting the sanctity of the sites. He raised concerns about obstructions in conducting scientific surveys, asking:

“If the Muslim community believes that it is a fountain and not a Shivling, why are they not allowing an ASI survey to be conducted? If it is a fountain and not a Shivling, it must be investigated, and if we have misled the nation, it will be exposed.”

This, he argued, is a matter of transparency and accountability, which the judiciary must ensure. Jain cited the Supreme Court’s landmark intervention, noting that for the first time in Indian legal history, the order of the Civil Judge, Senior Division, was subsumed in a higher judicial directive. The Supreme Court had directed that the disputed area be kept sealed, reflecting the sensitivity and national importance of the case.

Jain warned of the consequences of neglecting Hindu heritage, linking it to national identity and civilisation preservation, “We cannot imagine a nation without Gyanvapi, we cannot imagine a nation without Shri Krishna Janmabhoomi, we cannot imagine a nation without our temples, we cannot imagine a nation without the Hindu civilisation.”

He also highlighted the ongoing humanitarian responsibility of India, urging support for Pakistani Hindu refugees living in shelter homes across the country, reinforcing the idea that protecting Hindu interests is inseparable from protecting human dignity and cultural roots.

Advocate Jain underscored that the legal proceedings must take into account the rights of the majority community, arguing that constitutional principles cannot be used to undermine its basic rights, “Today, before the honourable Supreme Court, members of the majority community are saying that within our national framework, against the principles of the Constitution, the majority community has been violated on the basic principles of law, and that has to be heard.”

He stressed that nation-building cannot come at the expense of civilisational heritage, “When we are talking about Nation First, when we are talking about building a nation, we must know that we cannot build a nation after sacrificing the interests of the majority community.”
