WASHINGTON DC: The United States Congress urged the US mission to the UN and its representatives to oppose the Myanmar military junta’s attempt to secure representation at the United Nations (UN). The open letter by the US Congress to the country’s mission in the multilateral body, raised concerns about legitimising the military-backed junta rule in Myanmar via UN and reiterated it as antithetical to the democratic aspirations and civilian safety.

The appeal by the US Congress comes as the Trump administration, on the other hand, intensifies diplomatic engagement or backchannel talks with Myanmar’s junta on key economic issues pertaining to critical minerals, rare earth elements, businesses, eliminating cyber scam and other strategic sectors. Recently, representatives of the Trump administration held second round of talks with Myanmar junta in Tokyo, Japan. However, outcomes of the meeting and key details are not officially disclosed.

US urges to block Myanmar junta at UN from gaining legitimacy

The United States Congress urges the Washigton mission, to maintain its support for Myanmar’s current Permanent Representative to the UN, U Kyaw Moe Tun who have been appointed by the then democratic government of Naypyidaw. The US also urges to oppose any attempt by the military junta to replace the present permanent representative with a representative appointed by the military-backed government, as that would legitimise the unelected and undemocratic junta rule.

In a letter addressed to the US Mission to the UN, the appeal urges Washington to engage early with fellow members of the UN General Assembly Credentials Committee, the Office of the President of the General Assembly and like-minded member states to prevent the junta from securing formal recognition at the UN, by changing the representative.

Myanmar’s representation at the United Nations has remained unchanged since the military coup of February 2021, as the Credentials Committee has deferred a decision on the competing claims to represent the country. This arrangement has allowed Myanmar’s democratic representatives to continue engaging with the UN on humanitarian access, civilian protection and the prevention of atrocities, reads the open letter by the US Congress.

US flags legitimacy risks amid coercion, conflict & violence in Myanmar under junta rule

The appeal argues that changing the existing arrangement would risk legitimising a military regime that seized power from an elected government and continues to rely on coercion, violence and emergency decrees to maintain control. The letter also maintains that Myanmar’s latest electoral process cannot establish democratic legitimacy, given that it unfolded amid armed conflict, mass displacement, political repression, the detention of opponents and the exclusion of major democratic parties.

According to the appeal, presenting military rule as civilian governance does not address the absence of constitutional authority, popular consent or a credible democratic mandate. The letter further states that the United States has historically supported democracy, human rights and accountability in Myanmar, against coup and civil war. Thus, any attempt to allow Myanmar military junta appointed representatives at UN, undermines democracy and human rights.

The US appeal argues that abandoning the existing UN representation arrangement would contradict the US principles and undermines the credibility of the international organisation.

US raises Myanmar junta nexus with China and Iran; Claims threat to civilian safety

A central concern raised in the appeal by the US Congress to country’s UN mission is the potential geopolitical consequence of allowing the military junta to strengthen its position at the United Nations. It warns that permitting Myanmar’s military-backed leadership at the UN will strengthen voting & voice of the China and Iran at the multilateral body as Beijing, Tehran and junta leadership of Naypyidaw are hitherto aligned. US flags this nexus as threat to democracy and civilian safety.

The letter argues that junta relies on partners such as Iran and China for diplomatic protection, military cooperation, economic support and access to fuel used in airstrikes against civilians. So, if the junta representatives are permitted at the UN, it sends wrong message internationally and causes steep threat to civilian security, the US appeal further adds.

Credentialing a junta-appointed representative could therefore provide diplomatic benefits to a military establishment who is accused of suppressing its own population while deepening its dependence on authoritarian partners, the US letter reiterates. The appeal contends that such a move would reward the military leadership for seizing power, repressing political opponents, conducting a non-credible electoral process and relying on foreign support to sustain its rule.

It also warns that any change in Myanmar’s representation would fail to reflect the will of the Burmese people or their democratic aspirations. As a leading UN member state and a customary member of the Credentials Committee, US Congress urges Washington representatives to make its position clear.

Trump rule and Myanmar Junta hold backchannel talks in Japan

Meanwhile, the Trump administration has stepped up direct engagement with Myanmar’s military-backed government. The United States and Myanmar held talks in Tokyo last week.  The meeting marked the second round of talks between the two sides in a month, signalling that Washington is keen to sustain dialogue with the military leadership it had largely shunned following the 2021 coup. However, the talks are confined to specific strategic sectors such as access to Myanmar’s vast rare earth & critical resources, businesses, action against anti-US cyberscam centres in Myanmar etc.

The latest discussions followed an earlier meeting in Myanmar’s capital, Naypyitaw, in mid-September. That round of talks focused on securing the release of an American businessman and shutting down scam centres targeting US citizens etc. US Assistant Secretary of State for Intelligence and Research Michael Vance again led the American delegation in Tokyo, one person familiar with the meeting told the media. More than a dozen US officials reportedly participated, although it was not clear what the two sides discussed.

The engagement was rooted in the pursuit of practical gains for Americans, particularly those affected by transnational crime, sources said.

Scam centres and rare-earth minerals drive Washington’s engagement

A major priority for Washington is securing Myanmar’s cooperation in dismantling scam networks involved in romance fraud and other online financial crimes that have cost Americans billions of dollars. However, enforcement remains complicated. Researchers say many scam operations are based in areas controlled by army-backed militias, with some proceeds allegedly flowing to the military. Myanmar’s military-backed government has said that it is participating in a multinational effort to combat scam centres.

Beyond transnational crime, access to Myanmar’s deposits of heavy rare-earth elements has emerged as another potential area of strategic interest for the Trump administration. Significant obstacles remain. Many of Myanmar’s rare-earth deposits are located in territories controlled by ethnic armed groups fighting the military, while China, the principal buyer of Myanmar’s rare earths, could resist an expanded US role. Thus, thwarting China-Myanmar junta rule nexus, is speculated to be among the key agenda of the US talks with the military.
