Justice is a broad concept; it is not just a distinction between right and wrong, but is also a means to build a civilised society. Once Kautilya gave divine views on _Nyaya_ and _Dand_ in his Arthashastra. Justice is the medium through which even the last person in society can hope for a respectable life for himself. Justice has a very important place in the concept of Antyodaya and Integral Humanism.
The judicial system also appears one-sided under colonial influence. The process of justice, the language of justice, the dress of the lawyer and other elements of justice are all affected by colonial influence. The broad concept of justice also became narrow under colonial influence. The justice which was supposed to be all-inclusive kept moving towards narrowness. Now gradually, through many efforts, the picture of the Bharatiya concept of justice is coming before us. A campaign called Justice in Bharatiya languages is being run continuously across the country by the Bharatiya Bhasha Abhiyan Project by Atul Kothari, National Secretary of Shiksha Sanskriti Utthan Nyas. Positive changes like justice and the judicial process in the Bharatiya languages are being seen in the courts of many states.
Yesterday, the Chief Justice of the Supreme Court, Hon’ble Justice Bhushan Ramakrishna Gavai, took the oath of office in Hindi, which is a milestone in the success of this campaign. This is a moment of pride for the entire country because it is a guarantee of comprehensive justice. If the courts give judgments in foreign languages, then the plaintiff and the defendant do not understand whether the judgment is in their favour or not. If their advocates argue their case in foreign languages in the judicial process, then they do not understand what argument the advocates are putting. In this way, linguistic justice is not done to the plaintiff and the defendant who want justice. The absence of linguistic justice is an obstacle to the comprehensive concept of justice.
The oath taken by Justice B R Gawai in the Indian language is a positive sign. Amrit Kaal is the right time to root out colonial symbols. Other improper colonial symbols prevalent in courts and the judicial process should also be despised.
