RSS Sah Sarkaryavah Shri Arun Kumar said, we have all the top constitutional posts like President, Vice-President and Prime Minister occupied by the ordinary people, born in ordinary families, first generation learners and first generations politicians. “This is not a small achievement. This was possible because civilisationally our mindset was tune to the democratic values. Even our Raj Tantra was not feudalistic like Europe in nature. Hence, our society could adapt to the modern democratic norms,” said Shri Arun Kumar while addressing the 16th National Conference of Akhil Bharatiya Adhivakta Parishad in Haryana.
“Many developed countries have not adopted the EVM technology for the electoral purpose. We have done that. There are many other achievements in the last seventy-five years. But, colonial aggression, both Islamic and European have damaged many of our social and religious institutions. Fortunately, we have a society that is keen to get rid of any reminiscent of colonialism. How are we going to channelise this urge to rebuild our institutions is the biggest challenge of the next twenty-five years,” Shri Arun Kumar further added.
Union Law & Justice Minister Kiren Rijiju on December 26, 2022, said that appearing before lower courts does not make any lawyer’s stature small and no court is superior to another, but some courts have the authority to hear appeals and it does not make them superior.
Union Law Minister further added that there are some Lawyers, who get all the big cases and they earn crores of rupees. Such lawyers were so busy that they were appearing in multiple courts simultaneously through virtual hearings during the pandemic.
“It is a sad situation if people go to some lawyers thinking that the lawyer has a high reach and can do “fixing”. “Big lawyers” should give opportunities to new junior lawyers and “teach them,” Law Minister said. Rijiju further added that judges will have to face public scrutiny even though they are unelected.
While addressing the Conference, Justice GR Swaminathan said, “All of us present here will re-read Justice Abdul Nazeer’s lecture given under the auspices of Adhivakta Parishad last year, line by line. It is in English, let us translate it into our respective languages and have it distributed as wide as possible through every possible source. I can proudly tell you, l got it translated into Tamil and it was released a few months back.”
Notably, Justice Abdul Nazeer in September 2021 had said that there can be no doubt that this colonial legal system is not suitable for the Indian population. The need of the hour is the Indianisation of the legal system.”
“Ours is Dharma which is preservatory in theme. Theirs is predatory in approach. Whether a predatory approach can be superimposed on a Dharmic society like ours is a fundamental question that we have to necessarily ask”, Justice Swaminathan said.
He said that though England and France are nearby, their legal systems are different. “India which is so far apart, why should we blindly adopt the English system”, Justice Swaminathan asked citing fundamental differences between British and Indian societies.
