Since July 2019, instant triple talaq has been outlawed in the country and the Supreme Court has also declared it unconstitutional in 2017.

In a shocking case in Bareilly in Uttar Pradesh, a husband divorced his wife through triple talaq for not bringing an inverter in dowry.

When the wife is pressed for her return, the husband and his family are pressurising her for halala. Halala is an Islamic practice that “involves the woman marrying someone else, consummating the marriage and then getting a divorce – after which she can remarry her first husband.”

The victim was married to her husband in December 2019. After the marriage, her husband and his family started demanding an inverter in dowry, which her family couldn’t provide.

When she couldn’t bring an inverter, her husband’s family started harassing her physically, mentally and sexually.

They aborted her child two times and forcibly sent her to her parent’s house.

Meanwhile, the husband got married to another woman.

When the victim approached the police with a complaint, the husband’s family approached the victim to compromise but insisted that she does halala with her husband’s brother.

Since triple talaq is outlawed, the police have registered a case under various sections of the IPC against the victim’s husband and his family.
