Uttar Pradesh: A Victim of State Goondaism?

Intro: Senior IPS officer Amitabh Thakur being victimised for exposing misdeeds of ruling Samajwadi Party Ministers. State  government quickly suspended the whistleblower IPS and also withdrew his security.

SP Supremo Mulayam Singh Yadav’s threat to senior IPS officer Amitabh Thakur is the blatant example of state goondaism, through which he wants to crush the rebellious voice in UP. Thakur has released the audio of the phone call in which Yadav threatens him: “I am telling you, aap sudhar jaaiye… This is all I want to say.” In the audio, Mulayam Singh is heard reminding Thakur about an event that both attended, at a time when he was the Chief Minister. The officer is heard saying: “Sir! aadesh kya hai, mai samajh nahi paa rahaa hun?” Without answering him, Mulayam Singh cuts in and tells him that there could be more dire consequences, if he doesn’t mend ways.
Thakur gave an application to Hazaratganj Kotwali seeking FIR against Mulayam Singh, alleging that he threatened him of dire consequences. The audio of the purported conversation between them was also released. And certainly this is surprising that a long time politician and Ex-Chief Minister can speak in this language. Thakur, the state’s Inspector General, Civil Defence, was suspended hours after he went to the Centre seeking protection for him and his wife, Nutan Thakur, who has filed a corruption case against a SP Minister Gayatri Prajapati. Amitabh alleges that he is being targeted because of the case pending with Lokayukta.

  • What would you say about the authenticity of the tape released by you as recording the voice of Mulayam Singh Yadav threatening you?

His voice is very much known to me. Chief Minister Akhilesh Yadav also admitted it when he said Mulayam Singh Yadav admonishes even the CM. Secondly none from his family has denied the authenticity of the tape. In that tape, Mulayam Singh Yadav mentions his meeting with my father-in-law, which is something known only to me or him.

  • What is the status of your FIR lodged against Yadav?

I have been requesting the police to register it. They asked for the tape, which I have handed over. But still the FIR has not been registered. Now I will go to the court under Section 156/3 of the IPC.

  • You demanded CBI probe into the whole episode. What is the progress on that front?

I appeared before CO Gomtinagar in order to submit some details regarding the rape allegation made against me by a woman. If I feel that the CO is not proceeding into the matter honestly, I may also think of going to the High Court and file a petition praying for CBI Inquiry into the entire episode right from our complaint to the Lokayukta against SP Minister Gayatri Prajapati, who is very close to CM’s father. My wife, Nutan Thakur, was also threatened on January 3, 2015.

  • What might be the cause of displeasure, which angered Netaji?

I don’t remember anything else other than the complaint against SP Minister to Lokayukta made by us. After that complaint my wife has constantly been receiving threats, due to which we lodged FIR that people are trying to frame us in different false cases. And that is what the rape FIR was, an attempt to implicate us. I had an apprehension of all this. Soon after Mulayam’s threat when I tried to lodge FIR, I was suspended and Vigilance inquiry was also started against me. The allegation against me in these cases is not new. I have already replied about these allegations to the officials concerned.

  • What are the actions taken in revenge against you since you tried to lodge FIR against Shri Yadav?

Many—FIR in bogus rape case, suspension, vigilance inquiry, etc.

  • So what is your strategy now?

So far as the departmental enquiry is concerned, I sent my replies within 24 hours. Two hundred page charge-sheet containing 16 points was handed over to me. Since I am confident that I haven’t done anything wrong, I don’t have to conceal or manipulate anything. In rape case, I demand CBI inquiry. In Mulayam’s case I will go to the court. In vigilance case, I will submit replies to the allegations made against me.

  • What might have irritated Mulayam Singh against you?

Only thing that comes to my mind is Gayatri Prajapati’s case. Because otherwise my department Civil Defense is least significant. No such work is there which can cause displeasure amongst people. FIR against SP Minister Gayatri Prajapati was lodged on July 9 and the very next day Mulayam Singh threatened me. Therefore the connection is apparent. Moreover, he also mentioned that I keep making complaints.

  • Can you send RTI applications, and file PILs while being in service?

Yes. I find nothing wrong in that. Although in the case of Gayatri Prajapati, the allegations to Lokayukta were submitted by my wife Nutan Thakur who is a social activist. But I feel that I have my own fundamental rights as a citizen which I can exercise while I am on leave. I went to Rampur when Azam Khan tried to convert Valmiki people by taking them under pressure. I went to Shahjahanpur when Gajendra Singh was murdered. I take interest and try to intervene when I feel that there is injustice and exploitation. It is not unconstitutional to involve as a citizen.

  • What happened to your demand of security?

Very apparent. No security so far. You can feel the risk to me and my wife. Only God is with us.

  • You contacted the Ministry of Home Affairs. What happened?

Nothing so far. Finally, I will have to depend upon Court only, it seems.

  • What would you say about Mulayam Singh and his party?

I am surprised to know that the leaders of Samajwadi Party can condescend to such low level. The husband of so-called rape victim also is local Samajwadi Party leader of Ghaziabad.

After suspension, Amitabh was also slapped a two hundred pages charge-sheet, in which the State Government accused him of dereliction of duty, anti-establishment approach and flouting court orders. He has also been charged with indiscipline and indulging in anti-government activities also. It all begins with the filing of a case against Gayatri Prajapati with Lokayukta and Mulayam threatened Amitabh the very next day of lodging the FIR against Prajapati. The IPS officer wants to take the matter to Court. His FIR hasn’t been lodged so far. On the other hand, FIR has been lodged against him in a fake rape case by a woman whose husband too is a local SP leader in Ghaziabad. Amitabh has suspended and a rape case has been lodged against the IPS officer in Lucknow's Gomti Nagar police station. The woman had lodged a similar case against the IPS officer on December 31, 2014, after the case against Gayatri Prajapati was taken up. But then the case could not be registered due to lacunae. Amitabh questioned the timing and called it vendetta. The Ghaziabad-based woman charged Thakur under IPC sections 376 (rape), 504 (intentional insult) and 506 (criminal intimidation). Thakur's wife, Natun Thakur, was also made co-accused in the FIR. The woman in her FIR says that last year Nutan had come to Ghaziabad where during her meeting, she promised job to her and invited her to Lucknow. The victim alleged that on 31 December, she went to Thakur's residence where she was raped when Nutan sent her to Amitabh’s room for interview. Amitabh Thakur wants CBI probe into the whole episode so that the common man may know the truth. Thakur met the officials of Union Home Ministry for security. It is surprising that even though he is a very senior IPS officer, the state government has withdrawn security from him.
After having conversation with  Ministry of Home Affairs (MHA) officials the other day, Thakur believes that there will be a suitable investigation of the fake rape case registered against him, but he has still demanded police protection. He met Shri Anant Kumar Singh, Joint Secretary of the Rajya Sabha, who has promised him that there would be investigation.Terming allegations of Amitabh Thakur against SP supremo Mulayam Singh Yadav as serious, BJP national vice president Om Mathur demanded that an FIR must be registered in the matter. “The allegation of threat on Mulayam by IPS officer Amitabh Thakur is a serious matter. A complaint has been give to the police in this regard and it should register FIR in the matter against Mulayam,” he told reporters.
Surprisingly Akhilesh Yadav has tried to justify his father’s act, and said “When Mulayam Singh Yadav can scold the chief minister, there is nothing wrong in his scolding an official.”                             –Dr Shakti Kumar Pandey
