Goa government moves Supreme Court seeking life imprisonment for convicted rapist Tarun Tejpal

Panaji: The Goa government has approached the Supreme Court seeking to upgrade the 10-year prison term of convicted rapist and former Tehelka editor-in-chief Tarun Tejpal to life imprisonment, calling the current sentence “inadequate and grossly disproportionate.”

The legal escalation comes after the Bombay High Court overturned Tejpal’s controversial 2021 trial court acquittal on August 6, convicting the 63-year-old journalist for sexually assaulting a junior colleague inside a hotel elevator during a magazine event in Goa in 2013.

The High Court had sentenced Tejpal to 10 years of rigorous imprisonment and ordered him to surrender to the Goa Police. Clarifying that it stands firmly behind the High Court’s findings on merit, the State’s petition, accessed by news outlets, focuses exclusively on the severity of the punishment.

Core Legal Arguments in the State’s Supreme Court Plea

Demand for Maximum Penalty: Representing the State, Solicitor General Tushar Mehta argued that the 10-year term fails to reflect the gravity of the crime. The plea asks the apex court to enhance Tejpal’s sentence to imprisonment for life to establish a firm judicial deterrent against workplace sexual violence.

Challenge to Concurrent Sentences: The Goa government strongly contested the High Court’s directive allowing Tejpal’s sentences for multiple counts to run concurrently. The State contends that Tejpal committed distinct acts of aggravated sexual assault on successive days, which legally warrant consecutive sentences rather than simultaneous service.

Abuse of Power and Authority: The petition emphasises that Tejpal exploited his status as a high-profile employer, mentor, and person of trust to violate a subordinate while she was performing her professional duties.

Rejection of Mitigating Claims: The State urged the court to reject Tejpal’s plea for leniency based on the 13-year lapse of time since the incident, his age, or his family obligations. The petition maintains that procedural delays caused during trial cannot serve as a loophole to soften penalties for serious sexual offences.

Reversal of “Perverse” Acquittal

In its landmark ruling, the High Court bench set aside the 2021 Goa sessions court judgment, branding the earlier acquittal “perverse.”

The High Court criticised the trial court’s reliance on stereotypical expectations of how a survivor should act, firmly rejecting the notion that a complainant must fit the profile of a “perfect victim” to be deemed credible.

The court also acknowledged the severe ordeal endured by the survivor, who faced nearly 1,000 pages of aggressive and character-assassinating cross-examination during trial.

Investigating Officer Sunita Sawant hailed the High Court’s conviction as a milestone victory for working women across all sectors who stand up for their rights.

Tejpal, who served seven months in prison following his initial arrest in 2013 before being granted bail by the Supreme Court, has maintained his innocence. He has dismissed the prosecution as a “political vendetta” by the governing BJP and indicated plans to appeal his conviction in the Supreme Court.

Sequence of Events in the Assault

Here is a timeline that is based on Goa Police chargesheets and the Bombay High Court records. The sexual assaults occurred over two consecutive nights in November 2013 during Tehelka magazine’s annual ThinkFest event at the Grand Hyatt hotel in Bambolim, Goa.

The survivor, a 27-year-old journalist employed by Tehelka, was working at the event.

First Incident (November 7, 2013) 

The Trap: Tejpal asked the journalist to accompany him to retrieve a guest (Hollywood actor Robert De Niro) from his room or escort him to a location.

The Elevator Assault: Upon stepping into the elevator of Guest Block 7, Tejpal deliberately delayed the lift. He pinned the survivor against the wall, trapped her physically, and sexually assaulted her. Despite her explicit refusal, vocal protestations, and physical efforts to push him away, he continued the assault until she managed to escape when the elevator doors reopened.

Second Incident (November 8, 2013)

Repeat Offence: On the following night, under the guise of work obligations, Tejpal again lured the survivor to the same elevator area.

Second Assault: He repeated the acts of physical restraint, isolation, and aggravated sexual assault inside the lift.

Internal Email & Formal Escalation

Nov 18–20, 2013: The survivor sent a detailed internal email reporting the assault to Managing Editor Shoma Chaudhury. Tejpal followed that up with an internal email admitting to a “bad lapse of judgement” and offered to step down as editor for six months.

Timeline of the legal aspect of the case

Nov 22–30, 2013: Goa Police take suo motu cognisance of media reports, file an FIR, and initiate a criminal investigation. Tejpal is arrested on November 30 after his anticipatory bail plea is rejected by a trial court.

Chargesheet Filed: Feb 2014 – Goa Police file a massive 2,846-page chargesheet charging Tejpal with rape, sexual harassment, wrongful restraint, and abuse of authority under Section 376(2)(f), 376(2)(k), 341, 342, 354, and 354-B of the IPC.

Supreme Court Grants Bail: July 2014 – After spending over seven months in custody at the Sada Sub-Jail, the Supreme Court grants Tejpal bail.

Charges Framed: Sept 2017- A Goa trial court officially frames charges of rape and sexual assault against Tejpal, initiating the formal trial.

Sessions Court Acquittal: May 21, 2021 – In a widely criticised ruling, Judge Kshama Joshi of the Goa Sessions Court acquits Tejpal, relying heavily on the “perfect victim” trope to question the survivor’s credibility.

Goa Government Appeals: May 27, 2021 – The Goa state government files an appeal before the Bombay High Court challenging the acquittal, branding the trial court verdict “perverse and legally unsustainable.”

High Court Overturns Acquittal; Convicts Tejpal: Aug 6, 2026 – The Goa Bench of the Bombay High Court sets aside the trial court ruling, officially convicting Tejpal of rape and sentencing him to 10 years of rigorous imprisonment along with a Rs 10.21 lakh fine payable to the survivor.

Goa Government Appeals for Life Term: Aug 18, 2026 – The Goa government approaches the Supreme Court demanding an enhancement of Tejpal’s sentence from 10 years to life imprisonment, challenging concurrent sentence directives. Now, with the State demanding the maximum penalty of life imprisonment, Tejpal faces his most severe legal reckoning to date.

Tarun Tejpal has moved the Supreme Court against the guilty verdict in the rape case. His legal team is challenging the Bombay HC verdict convicting him in the rape case. Tejpal’s plea to the country’s top court comes just days after the Goa bench of Bombay HC sent him to 10 years imprisonment on paper. Technically, though, he is still outside on temporary time granted by the court.

Following his conviction and 10-year sentencing on August 6, 2026, the Bombay High Court initially gave Tejpal two weeks to surrender. However, upon a request by his legal team to allow him time to appeal the verdict in the Supreme Court, the High Court extended his surrender deadline to four weeks. Because that four-week period has not yet lapsed, he remains out on bail while his legal team has now challenged the conviction before the Supreme Court, and the Goa state government is pursuing its separate plea seeking a life sentence.
