DEHRADUN: The first case of Halala under the Uniform Civil Code (UCC) has been registered in Haridwar, Uttarakhand. This is the first such instance since the state enforced the UCC. The Buggawala police filed the case against a man and his family members based on a complaint by his wife.
Details of the Case The complainant, Shahin, has leveled serious allegations against her husband, Mohammad Danish, and other members of his family. According to the police report, Danish is accused of harassing his wife and violating matrimonial rights. Police have invoked Sections 32(1)(ii) and 32(1)(iii) of the Uniform Civil Code, Uttarakhand 2024 (Amendment 2026), which specifically prohibit and penalize practices like Halala.

The police have tightened the legal net by applying not only the UCC but also other stringent laws:
- Uniform Civil Code, Uttarakhand 2024: Sections 32(1)(ii) and 32(1)(iii).
- Bharatiya Nyaya Sanhita (BNS), 2023: Section 115(2) (Voluntarily causing hurt) and Section 85.
- Muslim Women (Protection of Rights on Marriage) Act, 2019: Sections 3 and 4 (Related to Triple Talaq).
- Dowry Prohibition Act, 1961: Sections 3 and 4.
Police Action Against the Accused
The Buggawala police conducted a thorough investigation. Sub-Inspector Manoj Kumar prepared the charge sheet and presented it in the court of Judicial Magistrate II, Roorkee. In addition to the main accused, Danish, the FIR names his father Mohammad Arshad, as well as Parvez, Javed, and Gulshana.
It has been nearly 1.5 years since the UCC was implemented in Uttarakhand, and this is the first reported case of Halala during this period. Previously, no cases of Halala or polygamy had surfaced. The government maintains that the UCC has provided women with legal rights to equality, dignity, and security. Notably, marriage registrations in the state have surged from an average of 67 per day to 1,400 per day since the code’s enforcement.
