Bengaluru: In a major political and legal development that has sent shockwaves across Karnataka, a special court has convicted Congress MLA Vinay Kulkarni in the high-profile Dharwad Yogesh Gowda Murder Case, raising the imminent possibility of him losing his assembly membership.
The verdict was delivered by the Bengaluru Special Court, which found 17 out of 21 accused guilty in connection with the 2016 murder of former Dharwad Zilla Panchayat member Yogesh Gowda. Kulkarni, listed as Accused No. 15, was taken into custody by CBI officials immediately after the judgment and later shifted to Parappana Agrahara Central Jail.
The quantum of punishment will be decided on April 16, and legal experts say the sentencing will be crucial not just for Kulkarni’s personal liberty but also for his political future. Under existing law, any elected representative sentenced to more than two years in prison faces automatic disqualification from the assembly.
MLA post under serious threat
With the court having upheld charges of murder and criminal conspiracy, Kulkarni faces a minimum sentence of life imprisonment, with the possibility of even capital punishment depending on the court’s final order. This puts his MLA post under immediate threat.
If the court awards a sentence exceeding two years, Kulkarni will be disqualified as a legislator under provisions of the Representation of the People Act. This would not only end his current tenure but could also bar him from contesting elections for a specified period.

However, legal recourse remains open. Kulkarni can approach the Karnataka High Court seeking a stay on the conviction or sentence. If a stay is granted before disqualification takes effect, he may temporarily retain his MLA status. Otherwise, the assembly seat could fall vacant, triggering a by-election in the politically sensitive Dharwad rural constituency.
Complex case with political overtones
The case dates back to June 15, 2016, when Yogesh Gowda was brutally murdered inside a gym in Dharwad’s Saptapur locality. Initially investigated by local police, the case was later handed over to the CBI in 2019 following sustained demands from the victim’s family.
During the course of the investigation, the CBI alleged that the murder was politically motivated and named Kulkarni as one of the conspirators. He was arrested in November 2020 and later secured bail from the Supreme Court.

Interestingly, despite legal restrictions that barred him from entering his constituency, Kulkarni contested and won the 2023 Karnataka Assembly elections, defeating BJP candidate Amrut Desai. His victory, achieved without physically campaigning in the constituency, had drawn widespread attention at the time.

Out of the 21 accused, two turned approvers, leading the court to convict 19 individuals. However, two accused Vasudev Nilekani and Somashekhar were acquitted due to lack of evidence. The court also noted complications regarding one of the approvers, Shivananad, who allegedly gave contradictory statements, prompting the CBI to seek his reclassification as an accused.
