THE ruling of the Additional Sessions Court in Delhi calling on the CBI to reopen the 1984 Sikh riot case has led the Congress Party into shame. More than the Congress, the country’s premier investigating agency, CBI which had given a clean chit to Jagdish Tytler twice has also hung its head in shame. How the Congress Party is managing the agency can be seen clearly as to how it took pains to portray Tytler as an innocent lamb.
The Congress which had made Tytler a Union Cabinet Minister immediately after the Sikh massacre in which nearly 5,000 Sikhs lost their lives has to answer several questions as the party has also given him important political postings and is the party-in-charge for Odisha. The Congress has given scant respect to democracy when Tytler was again announced as the party candidate for the 2009 general elections, however a bizarre shoe throwing incident by a Sikh journalist on P Chidamabaram-led to Tytler hurriedly backing off.
As is known it was the Justice G.T. Nanavati Commission formed by the NDA which thoroughly probed into the anti Sikh massacre of 1984 and found that the CBI has not properly investigated the case related to Tytler . The commission gave its recommendations in 2005 when UPA was in power and as usual the CBI tried to support the accused without even bothering to do proper investigation and to try and take the testimonies of the witnesses .The agency took the stand that the witness were changing stands .
The CBI did give a closure report in 2007 which was not accepted by the court and again in 2009 the agency submitted a closure report stating that Tytler was falsely implicated which was accepted by the court.
It is interesting to note that the present investigation will again be handled by the same CBI which had worked over time to please its political masters to set free the accused without giving an iota of thought for conducting a proper investigation. It has made this investigation a sham and with the UPA in power and Tytler being a powerful Congress satrap of Delhi, the general public nor the people affected don’t find anything cheerful in this investigation.
The Congressmen who have been accusing Narendra Modi and the BJP government of Gujarat for the Gujarat riots does not accept the fact that law has taken its own course in Gujarat. A senior minister in the BJP government, Maya Kondani, was sentenced. The law was taking its own course there. Several accused were convicted and many were let off by the courts. The Congress government has rewarded the concerned officer who was instrumental in giving a clean chit to Tytler with a high profile government posting.
It will not be too difficult for one to assume that the Congress party will not intervene in the investigating process and again bring itself and the agency to shame as it is its wont which that party will clearly follow without fail.
Those affected in 1984 carnage will get justice only if there is a proper investigation and the government of the day does not meddle in the probe of a premier agency of the country which will lead to total chaos.
