ED raid confirms PWD irregularities; Karnataka PWD Minister Satish Jarkiholi

BENGALURU: The Enforcement Directorate’s searches linked to Karnataka Public Works Department Minister Satish Jarkiholi have triggered a fresh political storm in the State, with the central agency claiming that it recovered documents and digital evidence relating to alleged irregularities in the PWD and the collection of bribes from contractors.

The ED said the searches were conducted at 21 locations associated with Jarkiholi, his family members and close associates as part of an investigation into suspected financial transactions, foreign investments and cross-border dealings. The searches covered premises in Bengaluru, Belagavi, Gokak and Kolkata, according to the agency’s statement.

The searches, which continued for more than 36 hours at some locations, have intensified the political confrontation between the ruling Congress and the Opposition BJP. While the Congress has accused the Centre of using investigative agencies to target its leaders for political reasons, the BJP has sought explanations from Jarkiholi over the findings claimed by the ED.

The ED’s statement has now added another dimension to the controversy by specifically referring to material allegedly connected with the functioning of the Public Works Department.

According to the agency, documents and digital devices seized during the searches contained information relating to alleged irregularities in the PWD and the collection of bribes from contractors. The agency has also indicated that it is examining allegations that large sums were paid for securing government tenders.

The ED said a private entity identified as Indian Commerce Eastern Private Limited allegedly received money connected with the tender process. The agency is examining whether such funds were subsequently used for acquiring assets outside India.

The allegations are part of an ongoing investigation, and the ED’s claims do not by themselves establish criminal liability against the minister or any other individual. The exact nature of the documents, their evidentiary value and the identities of all persons who may ultimately face action will have to emerge from the investigation and any subsequent legal proceedings.

The agency’s searches were not confined to the minister’s residence. Premises linked to Jarkiholi’s daughter Priyanka, son Rahul, son-in-law Y.D. Manjunath and other associates were also searched. The ED said it was examining transactions involving foreign entities and possible cross-border financial dealings.

One of the significant findings cited by the agency was the alleged presence of unaccounted cash. The ED said it seized Rs 3.3 crore in cash that was not reflected in the accounts examined during the searches. Foreign currency, including US dollars and euros, valued at around Rs 15 lakh, was also reportedly recovered and seized.

The agency has also referred to overseas business interests allegedly connected to members of the Jarkiholi family. According to the ED, the searches brought to light documents concerning investments in foreign companies, including Eldorado Mining Resources and Zambia-based New Aurum Mining Limited.

The ED further claimed that Satish Jarkiholi had a 40 per cent interest in a company identified as Magnitude Star, which is involved in gold mining. Documents relating to foreign companies and investments were among the material seized during the searches, the agency said.

The foreign investment angle has become one of the principal issues surrounding the investigation. The ED is understood to be examining the source of funds, ownership structures, financial transfers and the relationship between domestic business transactions and overseas assets.

However, the political controversy has increasingly centred on the agency’s reference to the PWD. The allegation that documents connected with the collection of bribes from contractors were found at premises searched in the case is likely to provide fresh ammunition to the BJP, which has already been questioning the Congress government over allegations of corruption in public works contracts.

The development could also put pressure on the State government, as Jarkiholi holds the PWD portfolio. The department handles major infrastructure projects, including roads, bridges and other public works, involving large government contracts and substantial expenditure.

The ED’s reference to alleged bribe collection is therefore politically sensitive, particularly because the material reportedly concerns the process of obtaining PWD tenders. The agency is expected to examine whether contractors were allegedly required to make payments in connection with the award or execution of government contracts and whether such payments were subsequently routed through business or investment structures.

The BJP has maintained that the ED should be allowed to conduct its investigation without political interference. Opposition leaders are expected to focus on the agency’s latest claims concerning PWD-related documents, alleged bribe collection and foreign investments.

The findings have also raised questions about the alleged role of private companies and individuals who may have been involved in financial transactions connected to government contracts. The ED has searched the premises of company officials and owners as part of its investigation into the alleged flow of funds.

The agency’s statement indicates that the investigation is broader than a single transaction or location. It covers domestic business dealings, PWD-related allegations, foreign investments, cross-border transactions and the ownership or control of overseas companies.

The recovery of digital devices could prove significant as investigators examine electronic communications, financial records, transaction details and other data. Such material may help the agency establish the flow of money and determine whether there were links between the alleged tender-related payments and overseas investments.

The ED is also likely to scrutinise documents relating to the ownership and financial structure of the foreign mining companies mentioned in its statement. Investigators may examine whether the investments were properly disclosed, the source of the funds and whether all applicable laws governing foreign transactions were followed.

The allegations made by the ED will now have to be tested through the investigation and, if applicable, before the courts. Neither the recovery of documents nor the seizure of cash automatically establishes that the minister or his associates committed the alleged offences.

With the agency indicating that its investigation is continuing, further questioning, scrutiny of financial records and examination of digital evidence could determine the next course of action. The searches have nevertheless transformed what began as an ED operation into a major political confrontation, with the alleged PWD irregularities and contractor-bribe records emerging as the latest flashpoint between the Congress government and the BJP-led Opposition.
