Disturbed Areas Bill 2026: Rajasthan tightens property transfer ules

In a major policy move aimed at addressing rising communal tensions and preventing distress-driven migration, the Rajasthan Cabinet has unanimously approved The Rajasthan Prohibition of Transfer of Immovable Property and Provision for Protection of Tenants from Eviction from Premises in Disturbed Areas Bill, 2026

The Rajasthan Cabinet has unanimously approved a Draft Bill that restricts property transfers in areas designated as “Disturbed”, making a bold and significant move to curb communal violence and migration across the state. The cabinet on dated 21.01.2026 endorsed “The Rajasthan Prohibition of Transfer of Immovable Property and Provision for Protection of Tenants from Evicts from Premises in Disturbed Areas Bill, 2026”. It is pertinent to mention herein that taking into consideration the demographic imbalances in certain areas of Rajasthan leading to communal violence, disharmony, migration, and exodus of Hindus has made the need of the hour to introduce the mentioned Act in the state. The legislation aims to prevent distress of sales and maintain population balance in the sensitive zones. It is very significant to understand herein that if the area comes under the definition of a Disturbed Area, then neither the owner of the property nor the buyer of the property can make the sale without prior permission of the competent authority, contrary to which the provision of punishment is mentioned in the legislation. Violation of the proposed law will constitute a cognizable and non bailable offence, punishable with imprisonment and fine. In many parts of the state, Hindus live in mixed localities, which are being forced to migrate to different areas due to security reasons (increasing population of Muslim community), incidents of eve-teasing against Hindu women, and nuisance, paving the way to a hostile environment for Hindus to survive and live with dignity. Looking to the situation Hindus left with no other option either to leave their homes and houses status quo condition or to sell it to Muslim community in cheaper price and to leave the place (migrate) to other area, which thus is a reality in many areas in Rajasthan such as Tonk, Malpura, walled city of Jaipur, Jodhpur, Bhilwara, Kota, Ajmer, Udaipur, Chittorgarh, Sawai madhopur, Mewat area, Bikaner, Jhalawar, sad affairs of the state as mentioned areas are also becoming the hotspots of communal and radical violence with an alarming rate.

The mixed localities provides cultural conflicts whereat proliferation of street vending, meat shops, encroachment, puncture shops on streets creating hinderances and increasing of crimes and communal violence the feeling of vulnerability creeps upon Hindu population who thereby felt better to sell off their property(ies) and move out of such localities this results in the change of demography of the areas whereat non muslim population slowly moves out of the mixed localities while the muslims increasingly occupy the area and therefore to maintain the Hindu population and to provide them safety along with security it become the need of an hour to implement the “Disturbed Area Act” in Rajasthan as like as in Gujarat.

Affected areas from migration, due to fear of safety, security of their family, eve-teasing issues and other nuisance created by Muslims, are as under:

1) Vinay Talkies Area, Malpura (adjoining to the Muslim-dominated area, Hathai Mohalla) has around 150 houses, of which only 09-10 houses of Hindus are left. Around 25-30 houses of Hindus sold in last 10 years from this locality. Before 1992, the Mohalla was known as Maliyon ki Hathai and Mali, Kumhar, Khati, Jangid, Jain communities resided in the area, only few Muslim families resided there. A Shiv Temple was also situated in the mohalla and is closed for almost 06 years. Earlier, the Hindu-Muslim ratio was 90:10, and the present ratio is 07:93.

2) Chhipo ki Dhal, Malpura has around 120-130 houses, and only 03-04 houses of the Hindu community are left in the locality. Earlier, it was dominated by the Chhipa, Mali, Jain, and Tailor communities of Hindus. In last 05-06 years almost 06-07 houses sold to Muslims. Earlier, the Hindu-Muslim ratio was 95:05 and the present ratio is 3:97.

3) Jain Mohalla, Near Aadinath Jain Temple, Malpura, has 50-60 houses of Hindus and Jain communities. Around 05/06 houses sold to Muslims in the last 05-06 years. Earlier, the Hindu-Muslim ratio was 100:00, and the present ratio is 90:10.

4) Harijan Mohalla, Toda Road, Malpura has 40-50 houses of the Harijan community. Around 04-05 houses sold to Muslims in the last 05/06 years. Earlier, the Hindu-Muslim ratio was 100:00, and the present ratio is 90:10.

5) Sindhi Colony, Malpura is having approx 25-30 houses of Sindhi community and around 04-05 houses sold to Muslims in last 05/06 years. Earlier, the Hindu-Muslim ratio was 100:00, and the present ratio is 88:12.

Some examples of Exodus/Migration of Hindus in Jaipur:

I. On Dec 26, 2022, a protest was held in the locality by Hindu residents against alleged construction of Masjid by one Mushtakin Qureshi s/o Islamuddin r/o 46, Krishna Colony, Ramgarh Mod Road, PS Brahmpuri, Jaipur. The protestors had alleged Hindu exodus from the area and claimed that earlier there were 253 Hindus in the area whereas at present only around 100 Hindu families are residing.

II. In the intervening night of May 19-20, 2023, a small poster on the houses of Hindu families were found pasted outside the houses of 20-25 Hindu families of Purohito Ka Chowk, Kalyanji ka Raasta, Kishanpole, Jaipur claiming that Hindu residents of the locality are being compelled to migrate due to pressure from Fareed Qureshi INC Councillor (Ward 69, JMC, Heritage).

III. Further, on the intervening night of May 26-27,2023 small posters were pasted on the houses of few Hindu families (10-12) of Mehra Basti, Krishna Colony, Beniwal Kante k Pass, Ramgarh Road, PS-Brahmpuri, Hawamahal area, Jaipur claiming that Hindu residents of the locality are being compelled to exodus due to INC Councilor (Ward 12, JMC, Heritage) Moazzam Bano, her husband Akhtar Hussain, employees and officers of Municipal Corporation.

IV. In May 2024, a house in Shastri Nagar was being bought by local Muslims to build a Mosque in JP Colony (a Hindu-dominated area), Shastri Nagar, Jaipur. Local Muslim youth who bought the house released a video on social media stating that about Rs. 33 lakh is needed for the Mosque and appealing to the masses to donate money for the same. Further, in this regard, on May 21, local Hindus (10-12) submitted a memorandum to the District Collector, Jaipur, in protest against the purchase of land for the construction of a Mosque on the residential plot.

V. On Oct 24, 2025, a protest demonstration took place outside the Sheetala Mata Temple, near Khole Wali Gali, Subhash Chowk, PS Subhash Chowk, Jaipur, in support of the demand for the protection of the Sheetala Mata Temple and a legal investigation into the ownership of the land of the Sheetala Mata Temple. The Hindu residents of the area stated that a Hindu, namely Naveen Sharma, sold his house to a Muslim, situated adjacent to Sheetala Mata temple, Khole wali Gali, Subhash Chowk, Jaipur, and he also handed over the adjacent temple to the Muslim buyer, claiming the temple land as his own private property. In response, Hindu residents submitted a written complaint to the police at PS-Subhash Chowk, district. Jaipur is demanding protection of the temple and a legal investigation into the ownership of land.

VI. In last one-year, various areas in Jaipur including Purohit ka Mohalla, Nandpuri Colony, Ramgarh Mod, Bhatta Basti, several posters have been found pasted on walls of houses requesting residing Hindu families not to sell their properties to Muslim families. All of these areas were earlier dominated by Hindu community, however, in last few years several Hindu families sold their houses to Muslim families. The local Hindu families have expressed fear of demographic shift and called for unity against ‘Land Jihad’. The resident Hindu families expressed concern over the rising number of Muslim families in the area. They fear that the change in demography might lead to alterations in the culture and social dynamics of the region. The issues range from cultural differences like taking non-veg in open to women safety as Hindu women not feeling safe due to bike roaming of Muslim youths, creation of nuisance and hostile atmosphere in the Hindu areas. These issues have aggravated so much that the residents are expressing distress over the necessity of leaving their ancestral homes.

VII. The walled (Old) city residents claimed that the area is known as “Choti Kashi” in Rajasthan due to abundance of temples in the area. However, they allege that Muslim residents purposely throw meat and bones on the path leading to the temples making it impossible for Hindu devotees to visit the temples. They also allege that due to change in demography, many Hindu girls have fallen into the trap of ‘Love Jihad’ laid by Muslim youth in the area. They also allege that Muslim youth target Hindu houses even if two groups of Muslim fights among themselves. Many areas in the old city have Muslim corporators and thus Hindu residents allege that the Muslim population in the area is being purposely increased under the patronage of these Muslim corporators.

 

The walled City areas of Jaipur, having mix population is communally hyper sensitive and communal riots, incidents and tensions take place on various Hindu occasions like Kawad Yatra, Krishna Janmasthami etc. Once the Muslim starts purchasing house (s) belong to Hindu community in the mix localities, fear and tension prevails among Hindu community feeling that their safety and security are in danger as the Hindus are turning into minority in the areas/localities. Further, Hindu community people are in steady pace selling their houses in Walled city areas and moving /exodus from the area due to pressure tactics of local Muslim representatives.  Hindus have started requesting Hindu families not to sell the houses to Muslim families as Hindus living in the area find it uncomfortable to live with a non veg eating neighbors and youth roaming on bike creating nuisance and eve teasing Hindu girls. Further, the apprehension of Love Jihad is the main concern of the Hindu families residing in these areas.

Major communal incidents that occurred in the recent past in Jaipur and Malpura, distt.-Tonk :-

a) On Aug 23, 2018, a Kanvad Yatra (125-150) was obstructed by local Muslims near Truck stand, Malpura, District Tonk and started stone pelting. In the attack 14 Hindus (Kanvadias) were injured.

b) On Aug 11, 2019, during a Kanvad procession at Chardarwaza, PS Subhash Chowk, Jaipur a clash took place between Kanvadias and local Muslims. Later, the incident snowballed into major communal riots (Aug 12-14), with Muslim mobs carrying out rampage in Jaipur city including near Delhi Bypass near Idgah, Subhash Chowk, Galta Gate & Ramganj areas.

c) On Aug. 28, 2019, heated arguments took place between local Hindus (15/20) and some Muslim youths (3/4) over some petty issue in Kalyanji- Ka-Rasta, Chandpole area, PS-Kotwali, Jaipur city where Hindu mostly youths (150-200) were holding “Dahi Handi” programme in observance of “Krishna Janmastmi” festival. Immediately, a group of agitated local Muslims mostly youths (50/60) gathered in the area and started pelting stones.

d) On Oct. 08, 2019 (1800 hrs), stones were pelted by unidentified persons on Vijaya Dashmi procession (2500-3000), near Julahon Ki Masjid, Sadat Mohalla, Toda Road, Malpura, PS- Malpura, distt- Tonk.

e) On March 26, 2023, a Hindu Ranbheri Rally on the occasion of Hindu New Year was organized by Hindus which started from Chandwaji, tehsil-Amber, Jaipur and while it was passing through village-Tala Johada, Jamwaramgarh, PS-Raisar, distt- Jaipur, an altercation broke up between Hindu and Muslims which resulted in stone pelting from Muslims.

f) On April 23, 2023 (around 1530 hrs), while Muslim youths (03-04) were passing through a Hindu locality (Gurjar Mohalla), near Nagauri Mohalla, Malpura town, PS-Malpura (District Tonk) on bike bursting firecrackers, they were advised by a Hindu lady not to create nuisance in the locality (Hindu dominated). The Muslim youths instead abused and teased the lady it leads to scuffle by the muslim community against Hindus. The Muslim mob also attacked police personnel besides Hindu community people with sticks, axe and sharp-edged weapons. The local Hindus are worried about the safety, security and respect of their women folk after the recent instance of communal incident at Malpura. The situation of the Hindu areas adjacent to Sadat Mohalla, Hathai Mohala, Imam Bada and other Muslim Mohallas is very disturbing and grave as Muslim youths mainly loafers used to pass through Hindu localities frequently and create nuisance by the loud sound of their bikes and teasing the girls/women of Hindu community.

Therefore, Hindus residing in adjoining to Muslim populated areas are afraid and forced to vacate their houses/properties or sell to Muslims only as no one is ready to buy them. After 1992 communal riots/incidents, the migrations of Hindus (who resides near Muslim localities) have been increased. It is further stated that temples/religious places of Hindus/Jain communities are locked and encroached upon in those localities.  This modus-operandi may be termed as ‘Property Jihad’.

It is significantly important to mention herein that the condition is similar to many areas of Rajasthan, and the only reason cited behind the migration of Hindus is communal tensions, violence, lack of safety and no assurance of security.

Key features of the Bill

1. The state government or the competent authority can notify any riot-affected area or communally sensitive area as a “Disturbed Area” for an initial period of three years, which is extendable.

2. No person can transfer immovable property in a notified area without the prior permission of the competent authority (Collector).

3. The collector must conduct an inquiry into the subject, as the transfer is with free consent, the property is being sold at fair market value, and the transfer does not affect the demographic structure of the area.

4. Any act contrary to the provision of legislation shall be null and void in the eyes of law.

5. Violation of the provisions of the law is backed with penal provisions as the act shall be considered as an offence which is cognizable and non-bailable, provided with imprisonment ranging from 3-5 years along with fine.

It has always been seen that whenever the concerns of Hindus are being raised, either it has been termed as Propaganda or bracketed as communal in nature, but it is a sad reality that Hindus are migrating due to fear in many parts and cry for their safety and security. It can therefore be seen from the evidence that communal violence and tensions are the major reasons for the migration of Hindus, which needs to be curbed on an immediate basis so that Hindus can live with dignity and not leave with fear without safety. The legislation brings hopes of safety and security and balances the state’s demographic fabric.
