Reports of men raping Gau Mata have become a new normal now, video for the same was shared widely from Haldwani, Uttarakhand today (June 14). As per the viral video the accused man has been identified as Mohammad Nafees. The locals shaved his head and painted his face black in protest.

As per the viral video, the accused was nabbed by some locals while performing unnatural activities with Gau Mata. Raged locals dragged him to Lama Square and shaved his head off. Notably, the accused was wearing a ‘Kalawa’ (sacred thread) in his hands.

The police action, in this case, is awaited.

This is not the only case where Islamists have tried raping Gau Mata, Organiser has been reporting such incidents for a long time now. Some of the cases are listed below:

Four such cases have been reported in the span of four months. A man identified as Hasan Khan raped Gau Mata in the Durg district on May 28.

The video of the said, incident was shared widely on the internet and as a result, the police swung into action. The accused, Hasan was arrested from the Gondia district of Maharashtra on May 30.

Based on the investigation, police identified the accused as Hasan Khan, a cloth vendor and native of Delhi. The accused was residing here at Housing Board Colony.

After the video of the heinous act went viral on social media, several outraged members of the Vishva Hindu Parishad and Bajrang Dal demanded the arrest of the culprit at Jamul police station.

Notably, this is not the only incident that has happened in Chhatisgarh, back in March, Organiser reported two such cases from Bhilai and Balod districts.

A First Information Report (number–31/2023) was registered at the Bhilai Bhatti police station of the Durg District in Chhatisgarh. As per the complaint, Mohammad Sahil (18), Satish Chandra Das (20) and two other minors were caught raping a cow on the night of March 7.

A similar case was reported from the Balod District of Chhattisgarh on February 28. A First Information Report (number–93/2023) was registered at the Balod police station.

The complainant, Umesh Kumar Sen, District head of Bajrang Dal shared the video of the alleged incident with Organiser Weekly. The said incident took place on February 25.

Also, In July 2022, a man identified as Sheh-e-Alam raped a cow in Raipur, the capital city of Chhatisgarh. Alam was a truck driver by profession and he was performing the act near Satnam Square in the town. After the locals assembled and questioned him he started begging for mercy.

A similar case was reported from the Azad Chowk police station area of Raipur district in Chhatisgarh in October 2022. The accused was identified as Mohammad Kamal.

A similar incident was reported from Raipur in the month of October 2022 where an accused identified as Ram Prasad Maravi was arrested by the police on charges of rape. He was caught by the locals after he tied the legs of a calf and was about of rape her. A case under section 377 of the IPC and Prevention of the Animal Cruelty Act was registered against him.

The law in force requires an amendment

The accused committing such grave crimes are being less punished due to the lack of a dedicated law. There have been rising number of cases which are reported from across the country where miscreants do such acts with a mute animal but are not punished actually for the crimes they do.

There are two laws in place to curb such crimes, first is IPC 377 and the other one is either section 11 of the Prevention of Animal Cruelty Act or Article 48 of the constitution of India.

Section 377 of the Indian Penal Code

Whosoever commits the unnatural offence– voluntarily has carnal inter­course against the order of nature with any man, woman or animal, shall be punished with [imprisonment for life], or with impris­onment of either description for a term which may extend to ten years, and shall also be liable to fine.

Unfortunately, these accused walk freely even after getting booked under such a rigorous act.

Section 11 of the Prevention of Animal Cruelty Act

There are a number of subsections under two sections of this Act that are meant to protect animals from cruelty. The punishment mentioned in the act ranges from a fine of not less than ten rupees and may extend to fifty rupees, and in the case of the subsequent offence committed within three years of the previous offence, the accused will be punished with a fine of hundred rupees or with imprisonment for a term which may extend to three months, or with both.

Article 48 of the Indian Constitution

Article 48 of the Constitution of India is one of the Directive Principles (DPSP) which directs the state to make efforts for banning animal slaughtering of cows and calves and other milch and draught cattle. It further states to organise agriculture and animal husbandry on modern and scientific lines.

Except for article 377 of the IPC no law mentioned above deals with the cruelty that is being done on a regular basis with Gau Mata. Just like the Anti-Conversion Law, there should be a law against cow smuggling, slaughter and unnatural crimes.
