Uttar Pradesh: Man gives triple talaq to his wife, assaults and threatens her to perform nikah-halala in Farrukhabad

In Farrukhabad, Uttar Pradesh, a case of triple talaq and physical assault with a woman has come to the fore. The victim, Arshi Fatima, claims that her husband, Ali Ashraf Qadri, gave her triple talaq and is now pressuring her to perform nikah halala with her father-in-law. She has said that her husband has threatened to kill her.

The victim filed a complaint regarding the matter to the Maudarvaja Police in August 2022. However, no action could be taken.

The victim filed a complaint to DM Sanjay Kumar’s office. As the additional magistrate Narendra Kumar was leaving the office, the victim stood in front of the vehicle and security personnel handed over the complaint to the magistrate.

Following this, the DM arrived, and he assured her and stated that necessary action would be taken.
In her complaint, the victim stated, “I filed a report against the accused under crime number 373/2022, Section 323 of the Muslim Women Act, and complained to police station Maudarvaja in August 2022. The police have not yet taken any legal action against the accused in the matter.”

The victim also said that she was trashed and threatened him with a pistol saying that her dead body would not be found if she dared to take legal action against him.

The name of the accused includes Sayeedullah, Rihanna, Nida, Faizi, Shoaib, Mushir, Sarwar Hafiz,
She also said that her father-in-law was also eager to perform nikah halala with her, and more so, her mother-in-law was tactility supporting this misbehaviour. She added that in spite of being highly educated, their behaviour is horrendous.

Nikah Halal is an Islamic practice where the divorced couple wants to remarry again. Once a man divorces his wife, he can’t marry her directly. The woman must be married to a different man, consummate the marriage and divorce her second husband in order to marry the original husband.

This practice has been a sexually exploited tool by many. It is notable that the central government enacted against triple talaq in 2019 after the Supreme Court declared the regressive practice unconstitutional in 2017.
