Political Abuse of CBI Continues….
“I write to you on a matter of public importance. The Congress strategy in the face if its’ depleting popularity is clear. Congress cannot fight the BJP and Narendra Modi politically. Defeat stares them in the face. By misuse of investigative agencies they have so far tried various methods of falsely implicating Narendra Modi, the Chief Minister of Gujarat, Shri Amit Shah, the then Home Minister and also the Minister of Law, Transport & Parliamentary Affairs of the State of Gujarat and General Secretary of Bharatiya Janata Party and other important BJP leaders.” These are the opening words of the legally blazing letter written by Shri Arun Jaitley to the Prime Minister of India.
While taking various illustrations from cases in Gujarat namely, Sohrabuddin Encounter case, Tulsi Prajapati encounter, Ishrat Jehan encounter etc, Shri Jaitley explains the instances of legal misadventures of the government to target Modi and his associates.
While discussing the Sohrabuddin Encounter case Jaitley explains that Sohra-buddin was a noted mafia and been convicted under TADA. The letter further points out that the Attorney General’s appearance for the Union of India and designating himself as Amicus Curiae, objections raised with regard to the fairness of the CBI and complete missing of the Andhra angle of the case shows the partisan approach of the government. Shri Jaitley also reveals the shocking note of the Legal department of the CBI which says that there was no case against Shri Amit Shah but suggests that arresting Amit Shah was necessary since it was necessary to reach the eventual target of investigation of Narendra Modi. This note was approved by the Director, CBI, Shri Ashwani Kumar.
While discussing the Tulsi Prajapati encounter case as an extension to the Sohrabuddin case, the letter argues that the only evidence mentioned against Shri Amit Shah by the CBI in this case was that he was regularly in touch with one police officer Shri RK Pandian, IPS who was an accused in the case. This allegation is ridiculed by stating that as a home minister it was constitutional duty of Shri Amit Shah to be in touch with Shri Pandian. Another important conspiracy hatched by the CBI is mentioned in the letter explaining that CBI did not comply with the SC orders to complete the investigation of Tulsi Prajapati case within 6 months from 11-04-2011 and filed the Charge Sheet on 04-09-2012 so as to arrest Shri Amit Shah once again just few months before the Gujarat Legislative Assembly elections which were scheduled to be held before December, 2012.
In case of the arrest of Shri Gulab Chand Kataria, former Home Minister Rajasthan in Tulsi Prajapati case, the letter highlights that the claims of conspiracy being hatched in Jaipur with DG Vanjara, IPS are false as Shri Gulab Chand Kataria along with his wife had flown on 25/12/2005 to Mumbai and stayed there till 2/1/2006.
The widely discussed Ishrat Jehan encounter is also evaluated in the letter with the contention that the case was completely handled by the Intelligence Bureau of the Central Government (Central IB). The Gujarat Police merely acted on the inputs given by the Central IB that some persons, including two from Pakistan after infiltrating into India, were planning to eliminate important leaders like Shri Narendra Modi, Shri LK Advani, etc. It was the political establishment of New Delhi which collusively got filed a petition before the Gujarat High Court in the name of the relatives of the Ishrat Jehan. The letter also underlines the facts about the Ishrat Jehan as a LeT operative with reference to Union Home Ministry’s acceptance, claims of Jamat-ud-Dawa mouth piece and confession made by David Headly, a LeT operative during interrogation by the FBI of the USA.
The attempt to negotiate bargains by the CBI through visiting various police officers accused in the jails is ‘one of the greatest scandals in recent investigation history’, the letter alleges.
Invoking the recent news on allegations by one Bhavesh Patel, an accused in the Ajmer Sharif Dargah blast case that a section of the Congress Party leadership, certain Union Ministers and officials of the NIA investigating the case have been pressurising him to implicate senior leaders of the RSS. The letter charges that the standard formulation which the UPA Government and its investigative agencies are following against leaders of the BJP and the RSS. The post-retirement benefits provided by to the favorable IPS officers is also sighted as part of the larger conspiracy.
Besides this, Shri Jaitely also refers to cases like Dara Singh encounter case and attempts to implicate Rajinder Rathore, former PWD Minister of Rajasthan, Harin Pandya murder case, allegations made Sanjeev Bhat and recent statements by Shri DG Vanjara,IPS etc.
The leader of opposition in Rajya Sabha has in his strongly worded letter to the Prime Minister charged that the CBI and the NIA have colluded with the politics of the Congress Party in all the above referred investigations and demanded a Commission of Inquiry headed by a sitting of the Supreme Court in the politicisation and motivated investigation. The letter has created political turbulence in the political circles. It will be interesting to see how does the PM respond to these allegations, especially after he himself is under pressure on coal gate investigations.

Baba Ramdev is again in the hit list of CBI. He was questioned on October 11 in the alleged kidnapping of ‘guru’ Swami Shankar Dev who mysteriously went missing six years ago while taking a morning walk in Haridwar. The CBI said Baba Ramdev was grilled at agency headquarters in connection with the case last week. There are reports that he might be questioned again. Baba Ramdev claimed that the government was trying to frame him in the case through CBI.
In March, CBI had registered a case under Section 365 of Indian Penal code against unknown persons. The section pertains to kidnapping or abducting and wrongful confinement. The case was sent by Uttarakhand government on the basis of state police’s case to probe the disappearance of Dev, who had been living in Ramdev’s ashram but was missing since July 2007 when he had gone out for a morning walk. Baba Ramdev and his trusts are also facing a number of probes by the Income Tax, Service Tax and Enforcement Directorate for alleged evasion of taxes.
The misuse of Central Bureau of Investigation (CBI) continues unabated. On October 12 the CBI interrogated former Home Minister of Gujarat Amit Shah for his alleged connections with the 2004 Ishrat Jahan encounter case. He was questioned about the kind of dealings he had with police officers accused in case. The investigating agency acted on the recent claims made by jailed IPS officer DG Vanzara that the Modi government in Gujarat was “inspiring, guiding and monitoring” every police action from “very close quarters.” Amit Shah denied any wrong doing. The agency said it may call him again for questioning.
The BJP alleged that the ruling Congress is unable to combat Narendra Modi politically and hence is using the CBI to question his credentials and lowering his reputation before the general elections.
