HuJI militant Khalid Mujahid dies of illness on way to jail from court
During a decade, a total of 12,727 deaths in judicial custody were reported in the country and Uttar Pradesh recorded the highest number of such deaths with 2171 deaths. There are reports that majority of these victims were Hindus. But in no case the FIR was registered against any cop or the police officers were suspended. But in the case of a terrorist, FIR has been registered against 42 policemen and nine have been suspended. This is height of Muslim appeasement.
Dr Shakti Kumar Pandey from Lucknow
The Samajwadi Party government of Uttar Pradesh is setting harmful precedents by constantly deviating from standards of governance simply in order to appease the Muslims. The state government wants to satisfy the Muslims even at the cost of national security. On one hand, it initiated to withdraw cases against hardcore terrorists, on the other hand, when one of them died due to illness in police custody, cases of murder and conspiracy were slapped against from top police officials to security personnel.
Not only that, and this is the height of shamelessness, the government suspended nine police personnel who were escorting the terror accused from court to jail. This is really too much. If some strict measures were not taken by Parliament or the apex court to prevent such vicious attempts by the state governments, the nation’s security and peace will be at greatest risk.
A Natural Death
Khalid died of illness while on way to Lucknow jail from Faizabad court. Lot of hullaballoo was made by Muslim outfits and the government, as ever, succumbed to their pressure, lodging FIR against 42 persons former DGP Vikram Singh. Nine police personnel have been suspended with immediate effect. These suspended 9 police officers are different from these 42 policemen. The suspended policemen include Sub Inspector Ram Awadhram, constables Chandrashekhar, Anand Prakash, Jitendra, Manoj Kumar, Ramji Yadav, Deepak Kumar, Jaiprakash and constable driver Lalaram. All were posted at Lucknow police lines. They had escorted Khalid Mujahid, Tariq Qasmi from Lucknow Jail to Faizabad court. The suspension orders were issued by SSP Lucknow, J Ravindra Gaud. The reason being given for suspension is laxity in duty for not taking Khalid to nearest hospital for treatment.
Government Withdraws Cases of Terrorists
Khalid is the same terror accused whose cases along with several others were proposed to be withdrawn. The government’s plea later was rejected by the court. The soft approach adopted by Akhilesh Yadav is evident from the fact that just in about last two months, his government has recommended withdrawal of cases against 15 of the alleged terrorists held on various charges of subversive activities. Withdrawal of cases was initiated but the application was rejected by the court. Interestingly, the move was made even when all other political parties were opposed to it on the ground that Court is itself the appropriate agency to decide if they are guiltless.
The state government had filed an application on April 26 to withdraw cases against Khalid Mujahid and another accused Tariq Qasmi in 2007 serial blasts in Lucknow, Faizabad and Gorakhpur. However, a special court in Barabanki on May 10 rejected the UP government’s plea. These two accused were arrested on December 20, 2007 with the police alleging that they were carrying arms and explosives. Both were accused of executing the serial blasts at courts that claimed 15 lives and left over five dozen critically injured. The cops had also seized 1.25 kg RDX, detonators, gelatin rods, cellphones and SIM cards from them.
FIR against 42, Nine Suspended
In the present case while it is apparent that the victim died due to illness (even the CM has admitted it) the state government ordered FIR against 42 persons, in addition to handing over the case to CBI, and suspending nine police personnels. Lot of resentment is seen amongst officials over government’s action. They say the cops will feel demoralised. Former DGP Vikram Singh, who is also one of those against whom FIR has been lodged, says vehemently that the deceased was a terrorist and that the action taken against him was justified.
It is important to note that in several cases of custodial deaths in which the Hindus died, this government remained heedless and simply didn’t bother. And here even though the victim is a known terrorist and HuJI operative, being tried in serious and serial blast cases, the government acts shamelessly, punishes the police and gives patronage to the terrorists.
Sources in the Home Department of the State government confirmed that besides making move of withdrawing cases against alleged HuJI militants, Khalid Mujahid and Tariq Kashmi, both said to be involved in serial blasts at Court compound and Kashmi also in Gorakhpur, government also issued necessary directions to the respective districts to withdraw terror charges against 13 more alleged militants who all were lodged in jails. Sources confirmed that an order has been issued to the District Magistrate of Rampur also to withdraw cases of three terrorists, Zaved aka Guddu, Taj Mohamed and Maqsood, all involved in fidayeen attack at Group Centre of Central Reserve Police Force (CRPF) in Rampur. Besides, move has been already made to withdraw terror charges against Mohamed Khalid Akhtar, a resident of Lucknow, Abdul Mobin, hailing from Siddharthnagar, Naushad, Mohamed Yakub, and Nasir Hussain, all belonging to Bijnore. The said five militants were lodged in Lucknow district jail in connection with blasts at Reservation Centre in Charbagh and near Sahkarita Bhawan opposite Bapu Bhawan respectively.
The other prominent ones amongst whom move was made by the government to withdraw terror charges are Ahmed Hussain aka Babu, a native of Bijnore (lodged in Varanasi Jail in connection with blast there), Shameem, hailing from Chandauli (also lodged in Varanasi). In connection with terror activities in Kanpur city also, three alleged militants identified as Arshad, Imtiaz Ali and Sitara Begum, were lodged in the local jail there. State government also dispatched necessary orders for the local administration to withdraw cases against them also.
Khalid Mujahid, along with Tariq Qasmi, Sajjadur Rahman and Mohammad Akhtar, was being tried in the special court of Faizabad for his alleged involvement in carrying out serial blasts on court premises of Faizabad, Lucknow, Gorakhpur and Varanasi. All accused lodged in Lucknow jail were returning from Faizabad after attending the hearing.
In their return journey to district jail Lucknow, Mujahid fainted in the police van as the motorcade was passing through Ram Sanehi Ghat area of Barabanki. The escorting police team diverted the fleet to the District Hospital Barabanki. As they reached there around 5.15 pm, doctors attending on Mujahid pronounced him dead upon arrival.
After Khalid’s death, his uncle Zaheer Alam Rahi lodged an FIR against 42 persons including a retired top UP police officer and a senior serving cop for alleged conspiracy. Zaheer alleged that a team of STF officials raided his house at Madiahu in Jaunpur district and rounded up Khalid on December 16, 2007. He said he informed the detention of the Khalid to then DGP Vikram Singh, ADG Law and Order Brij Lal. In the FIR, Alam has stated that after Mujahid was found to be falsely implicated by R D Nimesh Commission, the government had moved an application for withdrawal of cases against Mujahidin in a Barabanki court which was rejected on May 10.
IG (Law & order) RK Vishwakarma said that the matter will be probed. “An autopsy will be done by a panel of doctors which will be recorded in camera for transparency. Besides, a letter has been sent to National Human Rights Commission (NHRC) for action and a magesterial enquiry will be carried out,” said Vishwakarma, adding that prima facie Mujahid suffered a heart attack and died, but an autopsy will be conducted to ascertain the cause of death.
