Inhunmane instances are rising in Chhatisgarh. Here two cases have been registered in less than ten days against boys for raping Gau Mata. Yesterday, Chhatisgarh police arrested Mohammad Sahil and three others in Bhilai. Whereas a similar incident was registered in the Balod District last month. All the accused have been booked under charges of rape.
An First Information Report (number–31/2023) was registered at the Bhilai Bhatti police station of the Durg District in Chhatisgarh. The status of the FIR as per the citizens portal is marked ‘sensitive’ and hence cannot be accessed.
As per the district head of the Hindu Yuva Mach, Ajay Yadav four youths including Mohammad Sahil (18), Satish Chandra Das (20) and two other minors were caught raping a cow on the night of March 7. One of the ‘Gau Rakshak’ while patrolling at night caught them red-handed. The security guard first saw the accused around 4 in the morning.
The incident took place at a cow home located in the Murga Square of the city. They had been performing the unnatural act with Gau Mata for the past few months and it was only after the security guard saw them they were caught.
Hindu activists other than the Hindu Yuva Manch reached the police station demanding strict action against the accused. Those protesting include Pankaj Yadav, Ajay Yadav, Sharda Gupta, Omkar Sahu and others.
These activists nabbed one of the accused who is a minor and asked him to apologise and say he will not repeat this ever.

On March 12, Town Inspector, Bhilai Krishna Kumar told Organiser Weekly that they had arrested all the accused named in the FIR. He did not tell the names of the accused but said they have been booked under IPC sections 377 (punishment for having carnal intercourse) and 34 (acts done by several people with common intention).
The Superintendent of Police, Durg, Abhshiek Pallav while speaking with media said after they received the complaint about the said incident they arrested all the accused and sent them to police custody.
A similar case was reported from the Balod District of Chhattisgarh on February 28. An First Information Report (number–93/2023) was registered at the Balod police station.
The complainant, Umesh Kumar Sen, District head of Bajrang Dal shared the video of the alleged incident with Organiser Weekly. The said incident took place on February 25.
Towards the end of the video, the accused can be seen dragging Gau Mata.
As per the FIR, In the Machli Bazar area of the city, a man identified as Radhe Satnami raped the Gau Mata which is unacceptable. The CCTV footage of the said incident was circulated widely on the internet and taking cognizance of the same the accused was later identified.
Sen demanded strict action against the culprit on behalf of the whole Hindu community.
Later the police nabbed the accused and sent him to jail. The accused in this case was booked under IPC section 377 (having unnatural sex with humans or animals).
Similar cases from the past
In July 2022, a man identified as Sheh-e-Alam raped a cow in Raipur, the capital city of Chhatisgarh. Alam was a truck driver by profession and he was performing the act near Satnam square in the town. After the locals assembled and questioned him he started begging for mercy.
An First Information Report (number–520/2022) in the case was registered at the Khamtarai police station of the Raipur district. Accused Alam was booked under IPC section 377 (Unnatural sex) and section 11(1)(c) of the Prevention of Cruelty to Animal Act, 1960 was registered against him.

This correspondent accessed the court order for the case and found these details; the accused is still under arrested and the arguments have been recorded in the case so far. The next hearing was scheduled to be on March 3.
A similar case was reported from the Azad Chowk police station area of Raipur district in Chhatisgarh in October 2022. The accused was identified as Mohammad Kamal.
As per the complainant Karan Kumar Nirmalkar, on October 17 around 4:30 in the morning he woke up listing to the cries of a calf. As soon as he came out he saw a naked man standing behind the calf. He raped the Gau Mata.
On his complaint (FIR number–310/2022), the accused Kamal was booked under IPC section 377 and section 11(1) of the Prevention of Cruelty on Animals Act.
A similar incident was reported from Raipur in the month of October 2022 where an accused identified as Ram Prasad Maravi was arrested by the police on charges of rape. He was caught by the locals after he tied the legs of a calf and was about of rape her. A case under section 377 of the IPC and Prevention of the Animal Cruelty Act was registered against him.
The law in force requires an amendment
The accused committing such grave crimes are being less punished due to the lack of a dedicated law. There have been rising number of cases which are reported from across the country where miscreants do such acts with a mute animal but are not punished actually for the crimes they do.
There are two laws in place to curb such crimes, first is IPC 377 and the other one is either section 11 of the Prevention of Animal Cruelty Act or Article 48 of the constitution of India.
Section 377 of the Indian Penal Code
Whosoever commits the unnatural offence– voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with [imprisonment for life], or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Unfortunately, these accused walk freely even after getting booked under such a rigorous act.
Section 11 of the Prevention of Animal Cruelty Act
There are a number of subsections under two sections of this Act that are meant to protect animals from cruelty. The punishment mentioned in the act ranges from a fine of not less than ten rupees and may extend to fifty rupees, and in the case of the subsequent offence committed within three years of the previous offence, the accused will be punished with a fine of hundred rupees or with imprisonment for a term which may extend to three months, or with both.
Article 48 of the Indian Constitution
Article 48 of the Constitution of India is one of the Directive Principles (DPSP) which directs the state to make efforts for banning animal slaughtering of cows and calves and other milch and draught cattle. It further states to organise agriculture and animal husbandry on modern and scientific lines.
Except for article 377 of the IPC no law mentioned above deals with the cruelty that is being done on a regular basis with Gau Mata. Just like the Anti-Conversion Law, there should be a law against cow smuggling, slaughter and unnatural crimes.
Gau Rakshaks demand action against the perpetrators
While speaking with Organiser Weekly, Gau Rakshak Omesh Bisen from Raipur said, there is a surge in the number of crimes against animals, especially Gau Mata in Chhatisgarh. Bisen is an active Gau Rakshak in the area and has been doing Gau Seva for the past twenty-plus years.
He said, crimes like these should not be ignored by the administration and the perpetrators must be punished so that no one in future dares to commit such crimes. With having Bhupesh Baghel’s government in Chhatisgarh he said, the smuggling of cow is rampant and if they would have not been active in protecting ‘Gau Vansh’ (he said) condition of ‘Gau Mata’ would have been vulnerable.
He concluded by saying, there is a need for a separate law to curb crimes against ‘Gau Mata’. We worship cows considering them our mothers. The government should not allow smugglers to chop them or commit crimes like these against them, he said.
Ajay Yadav whose team resuced the Gau Mata from the recent incident at Bhilai demanded strict action against the accused. He said even if two of them were minors but the trial must go on considering them as adults. They have raped ‘Gau Mata’ they are not juvenile anymore.
