J & K LG Launches Portal to Redress Complaints of Kashmiri Migrants About Occupation of Their Properties

The portal was launched by the Jammu and Kashmir Lieutenant Governor Manoj Sinha today (September 7). Last month, the government passed an order “for the preservation and protection of properties and immovable assets of displaced Kashmiri Pandits.”

 

The Lieutenant Governor of Jammu and Kashmir Manoj Sinha launched an online portal today (September 7) to complaints of Kashmiri migrants about their lands and other immovable properties. 

The portals can be accessed through jkmigrantrelief.nic.in or kashmirmigrantsip.jk.gov.in . 

Once the complainant submits the form on these portals, a unique ID will be generated, which will be automatically routed to the concerned district magistrate for redressal. 

The notification on the website says, “The Jammu and Kashmir Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997, provides for preservation, protection and restraint on distress sales of the immovable property of the migrants. Under this Act, the District Magistrate has been designated as the Custodian of the migrants’ properties. This portal enables the migrants to file any grievance connected to his/her immovable property or related to a Community Asset. The information so provided shall be shared by the Department of Disaster Management, Relief, Rehabilitation and Reconstruction with the Department of Revenue for necessary action for resolution of the grievance in a fixed time frame.”

It adds, “The applicant will be contacted on mobile/email by the concerned District Magistrate.”

Pakistan sponsored terrorists forced the Kashmiri Pandits to flee the valley, leaving behind their properties. Many locals occupied the properties left behind by the Pandits.

On August 11 this year, the J & K government issued a notification asking the returning Kashmiri Pandits to approach the respective district magistrates if the locals occupied their properties. 

In a written reply in the Rajya Sabha, NOA had reported, the Minister of State for Home Affairs, Nityanand Rai, had said: “Under the J&K Migrant Immovable Property Act, 1997, DMs of concerned districts are the legal custodians of the immovable properties of migrants, who take suo moto action on eviction proceedings in cases of encroachment.”
