“Water is a national resource”,  said the Supreme Court on the  Cauvery water dispute. The verdict is to be seen as a call for prudent use of national water resources, rather than viewing it as a victory or a setback for any State

In a landmark verdict the Supreme Court (SC) has held that water of an inter-state river passing through corridors of the Riparian states constitutes a national asset and no single State can claim exclusive ownership of its water. While the quantum of water the Supreme Court has allocated to each state is important, the judgement lays emphasis on prudent and judicious use of water for all the States equally.
The judgement of the Supreme Court has also endorsed the National Water Policy, which envisages that water sharing/distribution amongst the states should be guided by a national perspective with due regard to water resources availability and needs within the river basin. The SC ruling further observes that the quantum of water sharing between the states follows the principle of equitable allocation internationally recognised by the Helsinki Rules, Compione Rules and Berlin Rules (regarded as the guiding factor for resolving disputes and allocation of water of an interstate river), which has also been incorporated in the National Water Policy.


The SC ruling should remind us that while India accounts for 15 per cent of the world’s population, it has access to only about 4 per cent of the world’s fresh water resources. In India, fresh water is used for all purposes from drinking and agriculture to industrial needs too which has put enormous stress on the already shrinking water resources.

The  highest  court  of  the  country   realised  the  GROUND  REALITIY   of  Cauvery  water share  CRITICAL  factors   among   the  states of   Karnataka, Tamil Nadu, Kerala and Pondichery.    Though   Tamil Nadu Cauvery  basin is rich in   underground   water  resource, it  had  not   tapped  it   when  the  water  levels of   the  State   reservoirs  had fallen down.
However   river  water  is no  more  for  irrigation purpose  but   for  drinking.  It   must  be  used   for  drinking   purpose  only, irrespective  of   State.             
The   sensible   bench  of   Supreme  court,  in  its   final   verdict,  said  categorically  USE   10  TMC  OF GROUND  WATER  WHEN YOU  HAVE   WATER  SCARCITY. Since  1924   Karnataka  has been struggling  to  expand  its  irrigation   potentiality  by  the long  pending   legal  objections  by  TN  in  various courts  of   Delhi.  It  is  the  objective and  functional  verdict  for  which  the  aggrieved   States   should   agree   in  letter   and  spirit.
The Cauvery  basin  States  must  be sincere  without  any  prejudice  to  accept  the  constitution   of  Cauvery  Monitoring   Board  (CMB). The Verdict  must  be  effected  and  executed. According  to Tribunal  interim  order, distress  too  must  be  shared  equally . Unfortunately    this  crucial   factor  is not  settled   by   law! Cauvery  dispute   reaches  its  peak  when   KRS  dries !  How   to  share  water  when the  reservoirs of  KRS  Kabini, Hemavati  and   Harangi   will  be  below  average?  CMB  should  exercise  this  fact  with  more  logic  than adopting  water  Mathematics.
After all  in  federal democracy, the   aggrieved  states   should  sort out this,  instead of  moving  around  the  courts. Much  politics   poured    barrels  of   fuel  to  the  94  year water  problem.  Indeed    political  parties   kept  this  alive, whereas   the   highest  judiciary  found  an  amicable   solution for  this.

This judgement taken in right earnest should be seen as a call for sensible use of water. Though, the Supreme Court has observed that drinking water requirement of the overall population of all the States has to be placed on a higher pedestal, the sagacious use of water for agriculture and industrial purposes is the responsibility of the States. Though groundwater is being used for many purposes, over extraction has resulted in depleting groundwater availability, especially in water stressed states like Tamil Nadu and Karnataka.

Large parts of India have already become water stressed. Rapid growth in demand for water due to population growth, urbanisation and changing lifestyle poses serious challenges to water security. Keeping the issues related to water governance, management of water resources and future challenges in mind, the SC verdict has also called for the framing of a National Water Framework. The Framework should lead the way for essential legislation on water governance in every State of the country without affecting the federal structure to deal with the local water situation. Such a framework has to address the basic concerns and changing scenarios but provide solutions in a unified national perspective.
While many suggest inter-linking of rivers as one of the solutions to solve the country’s water woes, considering the repercussion it could have, it is a subject that still needs lot of deliberations by experts and other stakeholders. Many have also suggested that States like Tamil Nadu and Karnataka which have long coastlines should invest in desalination of plants. If not for drinking purposes, desalinated water can certainly be used for agriculture and industrial purposes. Water scarce country like Israel has shown the way ahead in this aspect.
In a nutshell, the Cauvery verdict is to be seen as a call for prudent use of national water resources, rather than viewing it as a victory or a setback for a State. While  welcoming or opposing the verdict, one should not forget that  to use water judiciously is larger responsibility of everyone.
