The Supreme Court had cancelled the appointment of Dr Rajashree MS as the Vice Chancellor of the varsity in October last year. The Court also issued a writ of quo warranto against Dr Rajashree after cancelling her appointment. The Supreme Court Bench issued the verdict in a petition filed by Professor Dr Sreejith, former Dean of Cochin University of Science & Technology (CUSAT), questioning the appointment of Rajashree as the VC. The Court found that the appointment was not in conformity with the regulations of the University Grants Commission (UGC).
Accordingly, Governor Arif Mohammed Khan, in his capacity as the Chancellor of the varsity, in accordance with UGC regulations, appointed Dr Ciza Thomas as the temporary VC of KTU.
Then, the State government issued a show cause notice to the VC-in-charge for taking over the charge without the government’s approval. When Ciza Thomas approached the Kerala Administrative Tribunal (KAT), they issued the order in favour of the state government. But, Division Bench of the High Court has stated that the government’s notice was illegal.
Ciza was also served with a memo of charge on her retirement day. With the latest court order, all further actions against Ciza, including the memo, stand quashed.
The latest development is a shot in the arm for the governor, who has been inviting the wrath of the CPM-led ruling Left Democratic Front (LDF) and quite often of the opposition Congress-led United Democratic Front (UDF) for always upholding the principled stand in all approaches.
Meanwhile, the confrontation between the governor and the state government still continues. The Governor said, if state government is for conflicts, it is warm welcome. He was obviously referring to the pending bills. He said Raj Bhavan has asked for clarifications; as soon as he gets it, necessary actions will be taken. The governor welcomed the High Court verdict in favour of the former KTU VC Ciza Thomas. He does not like to react to the chief minister’s stand that there is no need to go to the Raj Bhavan. He said, it is the confrontation line. That is why the government issued show-cause notice to the VC appointed by the Governor.
The governor said that he has sought clarifications to Land Utilisation Bill passed by the Cabinet in the wake of the complaints received regarding it. He is awaiting the government’s clarifications before taking any stand in it.
Since Arif Mohammed Khan took over as Governor of Kerala, the LDF regime led by CPM supremo Pinarayi Vijayan has always maintained confrontation with the head of state. CPM does not tolerate a governor with a principled stand. Khan has proved several times that he is not a mere rubber stand who enjoys the Raj Bhavan life with an ‘open pen’ to sign whatever papers are sent to him by the state government. He has told me more than once, the ministers who bring the papers to him find it difficult to explain the clarifications he seeks. Major conflicts came up with respect to university appointments, which the government pushes without rhyme or reason. He expressed his dissatisfaction when the UGC regulations were shown back bench.
