Strongly condemning the manner in which the Tamil Nadu police arrested and treated the Kanchi Shankaracharya and also is procuring evidence to implicate the seer in criminal cases, the National Council meeting of Akhil Bharatiya Adhivakta Parishad (ABAP), a leading organisation of legal experts of the country, has demanded that investigation in the case should be shifted to an independent and impartial investigating agency like the Central Bureau of Investigation (CBI). “The sworn statements given before the Judicial Magistrate by the main co-accused, Kathiravan and Rajani, in this case on November 24, that they were forced to give the confessional statements implicating the seer under torture and duress, show that a deliberate attempt is being made by the police to implicate Swamiji in a criminal case on extraneous considerations. The assertions of the Tamil Nadu Chief Minister, Smt. Jayalalithaa that there is clinching evidence establishing the involvement of Swamiji in the murder, raises doubt about her keen interest in implicating the Swamiji,” said the resolution passed at the meeting.

The two-day meeting was held from November 27 at Narayanamma Engineering College in Hyderabad. The inaugural session was presided over by former Supreme Court judge, Justice K.T. Thomas. Former Union Minister, Shri Aurn Jaitley was the chief speaker. The theme of the two-day meeting was ‘Judiciary, Judicial Activism, Constitutional Parameters, Checks and Balances’. Hundreds of delegates from 19 states participated in the meeting. Shri Suryakrishan, guide of the Parishad, was also present.

In another resolution, the National Council resented the attitude of the Andhra Pradesh government for its acts of commission and omission which led to the situation wherein heavily armed Maoist squads were openly waging a war, endangering the rule of law, public safety and making a mockery of the administration of justice. The resolution said that the government of Orissa seemed to be moving in the same direction as is seen from its latest actions. “The National Council warns the Orissa government not to repeat the folly of its counterpart in Andhra Pradesh. The Council calls upon the state and the central governments to see that no one, especially the groups who profess violence and are waging war as an accepted ideology, is permitted to subvert the rule of law and the constitutional system,” the resolution added.

The Parishad alleged that the Andhra government had meekly surrendered to the CPI (Maoist) leaders and their agents in the name of ‘peace’. The Naxalite leaders, cadres and agents are roaming freely, participating in public meetings permitted by the officers intimidating everyone through display of sophisticated weapons. These meetings are not mere pubic meetings with symbolic value. They are a display of defiance to the rule of law, the resolution said.

In another resolution the National Council said that the move to grant reservations to Muslims on the basis of religion, as done by the Andhra Pradesh government, would disintegrate the country and dismemberment was unfortunate as had already happened five decades ago. The Parishad urged the well-meaning public to be vigilant against all such unscrupulous efforts, sought to be embarked upon by a few vicious political elements and be ready to take all such legal steps to challenge such decisions if taken by such political parties. In another resolution, the Parishad called upon the legal fraternity and other sections of the society to strongly express their concern in all possible legitimate ways and sensitise the legal fraternity about the demographic imbalance.
