SC grants bail to former DMK Minister V Senthil Balaji in money laundering case

NEW DELHI: The Supreme Court of India has granted bail to V Senthil Balaji, the former Tamil Nadu Minister, in connection with a money laundering case related to the “cash-for-jobs” scam during his tenure as Transport Minister in the AIADMK government. Senthil Balaji was arrested in June 2023 by the Enforcement Directorate (ED) on charges of money laundering. The apex court’s decision to grant bail comes with stringent conditions attached.

A division bench comprising Justices Abhay S. Oka and Augustine George Masih announced the ruling after having reserved its judgment in August. “We have granted bail but under very onerous conditions,” the court stated while delivering its judgment.

The “Cash-for-Jobs” Scam
The charges against Senthil Balaji stem from his tenure as Tamil Nadu’s Transport Minister in the AIADMK government between 2011 and 2016. The ED has accused Balaji of abusing his official position by conspiring with managing directors of State Transport Undertakings (STUs) and other transport officials to extort bribes from candidates seeking jobs as drivers, conductors, junior tradesmen (JTM), junior assistants, and engineers in various state-run transport corporations.

While the alleged offenses occurred when Balaji was a minister in the AIADMK, he later defected to the DMK party and held a key ministerial position in the current government until his arrest. Ironically, Tamil Nadu Chief Minister M.K. Stalin, who had called for Balaji’s arrest when he was in the opposition, later defended his inclusion in the DMK government.

The Arrest and Court Drama
In June 2023, Senthil Balaji was arrested while serving as the Minister for Electricity, Prohibition, and Excise in Tamil Nadu. Following his arrest, Balaji staged what some critics termed “drama” by complaining of chest pain and was admitted to a private hospital owned by a relative of a senior DMK minister. He reportedly underwent surgery and later returned to jail, where a mini hospital-like setup was arranged for him.

His wife filed multiple habeas corpus petitions, and his legal team repeatedly sought bail, citing health reasons. Both the trial court and the Madras High Court, however, denied his bail applications, stating that releasing him would send “a wrong signal” and would be “against larger public interest.” Despite facing mounting pressure, Chief Minister Stalin resisted calls from opposition parties and even Tamil Nadu Governor R.N. Ravi to remove Balaji from the cabinet.

The ED had also raided Balaji’s premises and linked properties, as well as his office in the state Secretariat. The investigative agency filed a comprehensive 3,000-page charge sheet against Balaji in August 2023. Senthil Balaji’s bail plea had been rejected several times by the courts prior to the Supreme Court ruling.

Supreme Court’s Decision
The Supreme Court’s bench granted Balaji bail but with stringent conditions. Solicitor General Tushar Mehta, representing the ED, argued against the bail, citing delays in the predicate offense trial and the accused’s repeated requests for adjournments. The ED pointed out that Balaji’s side had sought 13 adjournments and that the trial could be completed in six months if there were no further delays.

During the hearing, the bench noted that while there is a higher threshold for granting bail in cases involving financial crimes like money laundering, such delays in prosecution could not continue indefinitely. The judges remarked that “stringent and higher thresholds for bail and delays in prosecution cannot coexist.” They referenced past cases, including Najeeb, to justify their decision to grant bail with strict conditions attached.

The specifics of the bail conditions have not been publicly disclosed, but legal experts suggest they are likely to include restrictions on Balaji’s movement and interactions, as well as regular reporting to authorities.

Political Reactions
Tamil Nadu Chief Minister MK Stalin took to social media platform X (formerly Twitter) to hail the Supreme Court’s decision. In his post, Stalin accused the Bharatiya Janata Party (BJP) of engaging in “vendetta politics” and using the ED as a tool to target political opponents. He likened the case to the Emergency era, stating, “Even during Emergency, imprisonment wasn’t this long. They thought they could shake up Senthil Balaji’s determination.”

Stalin further claimed that by keeping Balaji in jail, political opponents were attempting to break his resolve. He praised Balaji for standing firm in the face of adversity, describing him as an “iron fort.”

Meanwhile, DMK party workers celebrated Balaji’s bail by bursting firecrackers and raising slogans in his honor. While the decision to grant bail was met with jubilation within the DMK, it remains unclear whether Balaji will be reinstated in the Tamil Nadu cabinet.

Criticism of Celebration
However, critics of the DMK government pointed out the irony of celebrating a bail order, which comes with stringent conditions. Political opponents have accused the DMK of turning a blind eye to corruption and hailed the release of a minister accused of serious crimes.

“It is only in Tamil Nadu that a party celebrates the bail of a minister accused of corruption,” said a prominent political analyst. “The court granted bail with strict conditions, and yet, here we have a public celebration, which sends a wrong message to the people.”
