Citizenship Amendment Act : Northeastern States and Autonomous Council areas exempted from CAA 2019

Guwahati: The Citizenship Amendment Act (CAA) 2019 has been implemented on March 11 across the country. But in a major development, the Ministry of Home Affairs (MHA) has announced that Nagaland, Manipur, Arunachal Pradesh, Mizoram, and the Autonomous Council areas of Assam, Tripura, and Meghalaya will remain exempt from the Citizenship Amendment Act (CAA) of 2019. This decision, effective March 11, underscores the government’s commitment to protecting the rights of indigenous inhabitants in these unique regions.

Constitutional Safeguards: ILP and Sixth Schedule

The exemption is rooted in Constitutional provisions, specifically the Inner Line Permit (ILP) and the Sixth Schedule, which safeguard the rights of Indigenous Inhabitants. This strategic move aims to preserve the cultural and demographic richness of the Northeastern states.

Amit Shah’s Commitment to Indigenous Rights

Union Home Minister Amit Shah has consistently reiterated his commitment to protecting the rights of the indigenous people of the region. This commitment was evident during the negotiations and parliamentary discussions leading to the enactment of the CAA in 2019.

ILP Implementation and Tribal Areas Exemption

The CAA will not be implemented in states requiring an Inner Line Permit, such as Arunachal Pradesh, Nagaland, Mizoram, and Manipur. Furthermore, exemption is extended to tribal areas governed by autonomous councils under the Sixth Schedule of the Constitution. Notable examples include Karbi Anglong, Dima Hasao, and Bodoland Territorial Council areas in Assam, Garo Hills in Meghalaya, and various tribal areas in Tripura.
