The Bihar government amended Rule 481 of the Jail Rules, 2012 on April 10 this year. This cleared the way for gangster and former MP Anand Mohan to come out of jail. He was serving a life sentence for the murder of Gopalganj District Magistrate G Krishnaiah in 1994. Anand Mohan’s son Chetan is an MLA from the RJD, a partner in the Mahagatbandhan government in Bihar.

There was much talk of amending the rules to ensure the release of Anand Mohan. But the release order issued by the Bihar government shows that Anand Mohan is not the only one to be released. As many as 26 other prisioners are also being released. Anand Mohan’s name is at number 11 in the list of prisoners to be released.

On April 24, news agency ANI quoted, “Bihar govt issues notification regarding the release of 27 prisoners including Former Lok Sabha MP Anand Mohan Singh from jail.

He was convicted in the 1994 murder of Gopalganj District Magistrate G Krishnaiah.”

As per the media reports, Anand Mohan’s son and RJD MLA Chetan Anand was getting engaged on April 24, 2023. For this, he was already out on parole for 15 days. This payroll was ending on April 25, 2023.

Meanwhile, the Nitish government has released the release list of 27 criminals to be set free after the revision in Bihar Jail Manual.

As per a circular dated April 10, the Nitish Kumar-led Bihar Government removed the “murderer of a government servant on duty” category of prisoners by amending the Bihar Prisoner’s Manual, 2012. The amendment has specifically been made for the release of criminal-turned-politician Anand Mohan, as per the reports.

With this amendment, the murder of a government official or employee posted on the job will not be counted as grounds to deny the release of a convict after he or she has served his complete sentence.

The news of the release of these prisoners is coming at a time when the crime rate in the state is at all-time high. A few days back Union Minister of State for Home Nityanand Rai had shared the data of crimes committed after the formation of the Mahagatbandhan government in Bihar.

Since the formation of this government on 9 August 2022, there have been 4848 incidents of serious crime in Bihar. These include 2070 murders, 345 rape, 144 kidnapping and 700 cases of attempts to murder.

Notably, the source to the stats presented in the Tweet above is yet to be reveled. On the other hand Anand Mohan walks out of the jail now and is all free. While interacting with the media about the case he was arrested for, Mohan said, “I was arrested within 12 minutes to the murder of the official, I was framed falsely and that I have nothing to do with the murder”

It is pertinent to mention that, In 2012, the Supreme Court of India sentenced Mohan of life imprisonment. Anand has already served his sentence (the duration of a life sentence is deemed to be 14 years), Anand Mohan could not be released due to a provision in Bihar’s Remission (Avoidance) Policy 0f 1994.

On December 5, 1994, Anand and his band of criminals attacked and murdered an IAS officer during the funeral of the dreaded gangster Chotan Shukla. Chotan was the brother of former Janata Dal (United) MLA Munna Shukla.

Anand Mohan and six others, including his wife Lovely Anand, were named as accused in the murder that sent shockwaves throughout the country. After the murder, these accused were convicted and Mohan was sentenced to death by Patna High Court in 2007.
