“Our concerns may be climate change and other international problems like global warming, etc. but the work that has to be done for them should begin from the revival of our village pond. There is no harming in thinking globally but we should work locally,” said Akhil Bharatiya Pracharak Pramukh of RSS Shri Madan Das. He was addressing the concluding ceremony of the 12th national conference of Akhil Bharatiya Adhivakta Parishad in New Delhi on December 28. The theme topic of the conference was “Sixty Years of the Constitution: Road Ahead”.
The three-day conference was inaugurated at Mavlankar Auditorium on December 26 by senior advocate and Leader of Opposition in Rajya Sabha Shri Arun Jaitley, former judge of Supreme Court Justice CK Thakker and senior advocate and president of Supreme Court Bar Association Shri MN Krishnamani.
Shri Madan Das appealed to the advocates to devote 10 per cent of their professional time to the society and work with missionary spirit. He also appealed to the workers of the Adhivakta Parishad to expose the challenges before the society and work taking all people together. At the end, the conference adopted a resolution demanding immediate quash of the Ranganath Misra Committee Report saying that it would promote division in the society.
Justice (Retd) CK Thakker spoke elaborately on the changes in application of rule of law. He discussed the views expressed by Supreme Court with regard to principle of natural justice and the locus standi from 1950 to the present time. He also narrated an incident when an American judge not only agreed to receive dedication of the book written by Shri Thakker but also expressed his happiness over the Indian courts awarding compensation to the persons who were under unlawful detention and he said it should be followed by American courts too.
Shri Arun Jaitley spoke about the importance of public opinion in administration of state. He said the Constitution is a skeleton and judiciary fills the flesh and blood in it and judicial review subserves the Constitution. With regard to appointment of judges in Supreme Court, he suggested that there should be some criteria for the appointment and the criteria should be applied at the threshold of the appointment process.
Shri MN Krishnamani discussed the functioning of different functionaries of the Constitution particularly the judiciary. He said corruption has been there in the judiciary since long time but now the volume of it is more. He suggested formation of a National Judicial Commission to monitor the appointment and performance of judges.
Former judge of Andhra Pradesh High Court and president of Akhil Bharatiya Adhivakta Parishad Justice S Parvat Rao suggested the appointment of a National Judicial Services Commission. In the beginning, national general secretary of the Parishad and advocate of Supreme Court Shri Bhupender Yadav introduced the subject.
Shri Bal Apte, MP and senior advocate, presided the session and Shri Rajesh Gogna, advocate, Supreme Court of India, coordinated the session.
Smt Meenakshi Lekhi, advocate of Delhi High Court, said there should be proper machinery to implement the women laws, even though there are Acts enacted specially for women like Protection of Women from Domestic Violence Act, Dowry Prohibition Act but no protection officer has been appointed for the enforcement of these Acts.
Smt Purnima Advani, advocate of Bombay High Court and former Chairperson of National Commission for Women, while presiding the session said the laws enacted are not sufficient for the protection of the women and suggested to enact more laws and formulate the machineries to achieve the objective. Smt Chitra Sunil, advocate of Kerala High Court, coordinated the session.
Shri Baldev Mahajan, advocate of Chandigarh, presided over this session and Shri Arun Bhardwaj, advocate of Delhi, coordinated the session.
